Section 38 Youth Protection Act , R.S.Q. c. P-34.1) ______________________________________________________________________ WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified.
Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Director of Youth Protection submits that the security and development of the child, X, are in danger. [ 2 ] The child and the mother were present in court on May 2 nd 2016 in Town A. [ 3 ] They both admitted most of the alleged facts and accepted the measures proposed by the Director. [ 4 ] The child will be 18 next December. [ 5 ] He shows serious behavioural difficulties which put his life in danger. He can be very aggressive at moments.
He shows suicidal behaviours and ideations. [ 6 ] He admits consuming marijuana every day. [ 7 ] During the last moths, he needed to be hospitalized twice because of his suicidal ideations. [ 8 ] He went very far in his preparations to commit suicide as he was found with a rope and a gun. [ 9 ] He was entrusted to a group home since mid-March 2016. [ 10 ] He did not show any suicidal ideations since his placement but reacted strongly to his placement.
He ran away a few times. [ 11 ] He is still very impulsive and shows emotional distress. [ 12 ] He has the support of his mother but will also need the help of professionals such as an external educator. [ 13 ] He has a new girlfriend. He is very motivated to go back in his community.
[ 14 ] His regular marijuana abuse does not help him to regain stability and self confidence. [ 15 ] He has been out of school for the last two years. He will need to make a mature life project very soon as he will be an adult in the coming months. FOR ALL THESE REASONS, THE COURT: [ 16 ] GRANTS the motion; [ 17 ] DECLARES that the security and development of the child, X, are in danger in virtue of
section 38
f) of the Youth Protection Act ; [ 18 ] ORDERS that the child remain with the mother; [ 19 ] ORDERS that the mother report periodically to the Director of Youth Protection on the measures she applies in her own regard or in the child’s regard to put an end to the situation of compromission; [ 20 ] ORDERS that the child and the mother take an active
part in the application of the measures; [ 21 ] ORDERS that the child and the mother report in person at regular intervals to the Director of Youth Protection to inform him of the current situation; [ 22 ] ORDERS that the child and the family receive the services of an external educator for the period deemed necessary by the professionals; [ 23 ] RECOMMENDS that the child seek help through the CLSC concerning his issues; [ 24 ] RECOMMENDS that the services of a psychologist be offered to the child; [ 25 ] ORDERS that a person working for an institution or body provide aid, counsel and assistance to the child and the family; [ 26 ] ORDERS the police to collaborate to the execution of the enactment; [ 27 ] ENTRUSTS the situation of the child, X, to the Director of Youth Protection for the execution of the measures; [ 28 ] THE WHOLE until [...] 2016. __________________________________ JEAN GRAVEL, J.Q.C.
