[ 1 ] The Court is seized with an Application pursuant to section 545(1) of the Civil Code of Québec which provides that an adult can be adopted “by the persons who stood in loco parentis towards him when he was a minor.” [ 2 ] The Applicant, Mr. A , born on [...], 1970, is asking to adopt a person of full age, Ms.
X, born on [...], 1997. [ 3 ] Paternity of the person of full age has never been legally established. [ 4 ] The Applicant and the mother of the person of full age have been married since July 17 th , 2010. [ 5 ] The Applicant, the mother and the person of full age have been living together since 2006. [ 6 ] The Applicant has been acting since 2006 as a father towards the child and represents her only father figure. [ 7 ] The Applicant and the person of full age have develop a meaningful and positive father/daughter relationship. [ 8 ] The Applicant and the person of full age wish with all their heart to legally confirm their father/daughter relationship through adoption.
[ 9 ] The mother of the person of full age is of the same position. [ 10 ] The Applicant, the person of full age and the mother already constitute by all means a family. [ 11 ] The adoption is in the best interest of the person of full age. FOR THESE REASONS, THE COURT: [ 12 ] GRANTS the application; [ 13 ] PRONOUNCES the adoption of Ms. X, born on [...], 1997, by Mr. A , born on [...], 1970. [ 14 ] MAINTAINS the filiation between the person of full age, Ms. X and her mother Mrs.
B ; [ 15 ] ORDERS the Clerk of the Court to give notice of the judgment to the Registrar of Civil Status and to provide the latter with all information enabling him to establish a new birth certificate in conformity to
section 129 of the Quebec Civil Code ; [ 16 ] ORDERS the Registrar of Civil Status to comply with the requirements of the law; [ 17 ] ORDERS the clerk of the Court of Québec to give notice of a full copy of this judgment to the Applicant and the person of full age.
