Counsel at hearing: For the appellant: Richard J. Scott, Q.C. For the respondent: Donald V. Keenan and Nadia M. MacPhee Avocats à l’audience : Pour l’appelante: Richard J. Scott, c.r. Pour l’intimée: Donald V. Keenan et Nadia M. MacPhee THE COURT The appeal is dismissed with costs of $2,500. LA COUR L’appel est rejeté avec dépens de 2 500 $.
The following is the judgment delivered by THE COURT [ 1 ] Regardless of any errors that the trial judge may have made in arriving at his damages award, the appellant cannot have that award increased, in accordance with the trial judge’s provisional assessment, unless it is established that the respondent promised to provide the appellant with “premium salmon”. In that regard, the trial judge made an express finding to the contrary: see paragraphs 98 and 99 of the reasons for decision, cited as 2010 NBQB 225 .
The appellant has not established that this particular finding was infused with palpable and overriding error. Accordingly, the appeal will be dismissed with costs of $2,500. ____________________________________ J.T. ROBERTSON, J.A. _____________________________________ B.
