N o : 640-41-001000-071 DATE: February 28 th , 2012 ______________________________________________________________________ IN THE PRESENCE OF: THE HONOURABLE LISE GAGNON, J.C.Q. ______________________________________________________________________ IN THE MATTER OF THE CHILD: X Born on […], 1997 [SOCIAL WORKER 1], person duly authorized by the Director of Youth Protection A, working in Town A (Quebec), district A; Petitioner -and- A , unknown address in Town B (Quebec), district B; Mother -and- B , residing and domiciled in Town A (Quebec), district A; Father -and- LA COMMISSION DES DROITS DE LA PERSONNE ET DES DROITS DE LA JEUNESSE . ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] The Director of Youth Protection submits to the Court a motion for revision of a Court decision rendered June 5 th , 2007 by Justice Gabriel Lassonde in which the Court entrusted the child to a foster family until November 17 th , 2011. [ 2 ] In the fall of 2011, the Director of Youth Protection was about to recommend that the child be entrusted to the same foster family until his majority.
However, when the file was called to proceed on November 8 th , 2011 in Town B and on December 13 th , 2011 in Kuujjuarapik, the foster parents were absent and the case could not be heard. [ 3 ] On January 15 th , 2012, the foster mother explained to the social worker that she was confronted to serious personal problems. For this reason, she did not want to be involved in X' situation anymore. [ 4 ] That same day, X was placed in a new foster home with C and D. [ 5 ] X has adapted well to his new foster family. He gets along well with them. He follows their rules. X also attends school on a regular basis.
According to his teacher, he is one of the best students in class.
[ 6 ] Neither of the parents are involved in X' situation. This is why the Director of Youth Protection is asking the Court to authorize the foster family to sign for school, medical and travel consents. [ 7 ] In order to evaluate if X will continue to evolve well with his new foster family, the Director of Youth Protection recommends to the Court that the measures be ordered for a period of six months. [ 8 ] At the hearing, X is present with his attorney and he agrees to the conclusions.
FOR THESE REASONS, THE COURT: GRANTS this motion; REVISES the decision rendered on June 5 th , 2007 by Justice Gabriel Lassonde; DECLARES that the security and the development of X continue to be in danger; ORDERS that X be entrusted to a foster home for a period of six (6) months; ORDERS that the contacts between X and his parents be supervised by the Director of Youth Protection in terms of frequency and conditions, and only in respect of X' wish; AUTHORIZES C and D to sign for school, medical and travel consents; ENTRUSTS the situation of the child, X, to the Director of Youth Protection A C.Y.P.C., who shall then see that the measures are carried out; ORDERS the police to collaborate in the execution of this order; __________________________________ LISE GAGNON, J.C.Q.
