BERTRAND JACQUES CHANDONNET BENOÎT LAUZIÈRE SYNDIC OF THE BARREAU FONDS D'ASSURANCE RESPONSABILITÉ PROFESSIONNELLE DU BARREAU RESPONDENTS – Defendants and THE HONOURABLE JEAN-MARC FOURNIER OF JUSTICE MINISTER QUEBEC MIS EN CAUSE – Mis en cause JUDGMENT [ 1 ] The respondents ask by their motion that the Court dismiss the appeal lodged by the appellant against a judgment rendered by the Superior Court, District of Montreal, (the Honourable M r Justice Pierre Béliveau) on the 15 th of February 2012, which judgment denied appellant the authorization to proceed with a motion styled “ motion requesting that the court find the defendants liable for damages and interests for acting in a prejudiced manner against thep laintiff, and for deliberately neglecting to exercise their duties ( Arts 1376 and 1457 C.C.Q., Professional Code
Section 23 and 123 and
Article 33 of the C.c.p.)”. [ 2 ] The appeal has no reasonable chance of success and it is bound to fail. The judge below held that, manifestly, the appellant was attempting by means of his motion to persist in his harassment of his ex-wife S. M. and her counsel. At paragraph 31 of his reasons, the judge writes: 1. Le requérant vise manifestement à faire réviser indirectement les décisions des instances disciplinaires du Barreau rendues les 29 juin 2007 et 19 août 2008 , ainsi que celle rendue par la juge Trahan.
À cet égard, il est pertinent de mentionner que lors de l'audition, le requérant a déposé, malgré le délai fixé au 6 janvier 2012 pour produire toutes ces pièces, onze nouvelles pièces dont l'objet était manifestement de remettre en cause la décision de la juge Trahan; 2. Le requérant ne s'est pas pourvu en révision judiciaire de ces décisions, de sorte qu'il est, tout au moins a priori , difficile de concevoir qu'une injustice manifeste ait été commise; 3.
Le requérant a attendu plus de trois ans pour tenter d'exercer le présent recours, de sorte qu'il est, tout au moins a priori , difficile de concevoir qu'une injustice manifeste ait été commise; 4. La Cour a déjà refusé à deux reprises au requérant de porter une plainte privée au comité de discipline du Barreau, dans le but manifeste de remettre en cause les décisions rendues;
Le requérant porte des accusations racistes d'une manière tout à fait gratuite, ce qui tend à confirmer l'escalade dans son attitude quérulente; [ 3 ] It bears repetition that, on the 4 th of October 2007, another judgment of the Superior Court, confirmed by our court on the 1 st of December 2008, and rectified on the 13 th of March 2009, held that the appellant is a vexatious and querulous litigant as regards Ms M. and her counsel. [ 4 ] The appellant submits that paragraph 43 of the judgment, which forbids him to initiate certain proceedings, is too broad; but this paragraph must be read in conjunction with paragraph 44 which preserves the appellant’s right to begin proceedings against any person, provided such proceedings are not another iteration, directly or indirectly, of his claims against Ms M. and her counsel. Pour plus de certitude, mais sans restreindre la généralité de ce qui précède, la Cour indique que l'ordonnance vise le Barreau ainsi que ses organismes disciplinaires et les personnes qui en font partie. [44] DÉCLARE que le juge en chef de la Cour supérieure, ou celui désigné par lui, autorisera le recours sauf s'il vise une personne, tant personnellement qu'ès qualités, et ce relativement à toute question qui découle, directement ou indirectement, de tout litige ou différend que M.
P… N… a pu avoir ou pourrait avoir avec Mme S… M… et/ou ses procureurs; FOR THESE REASONS, THE COURT: [ 5 ] GRANTS the motion to dismiss the appeal, with costs; [ 6 ] DIMISSES the appeal, with costs.
