Robert Osadchuck Clerk BY THE COURT JUDGMENT [ 1 ] The petitioner's motion for leave to appeal beyond the delays was postponed on September 29, October 27 and December 1, 2014, in light of the petitioner's absence at the intended hearing. [ 2 ] He is again absent today for the fourth time to present his motion. [ 3 ] In the circumstances, the Court has no choice but to dismiss his motion for leave to appeal, without costs.
