Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on February 7, 2019. [ 2 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de prolonger son ordonnance rendue le 25 mai 2018. [ 3 ] Plus spécifiquement, elle demande de confier X (10 ans) à sa mère et qu’un suivi social soit offert à la famille pour une période de six (6) mois. [ 4 ] Toutes les parties admettent que la sécurité et le développement de l’enfant sont toujours compromis et sont en accord avec les mesures proposées.
CONTEXTE ET ANALYSE [ 5 ] La sécurité et le développement de l’enfant sont déclarés toujours compromis le 25 mai 2018. [ 6 ] Depuis la dernière audition, la situation évolue positivement. [ 7 ] La mère continue à éprouver des difficultés financières et demeure toujours avec le grand-père paternel. [ 8 ] La mère comprend que cette situation n’est pas idéale pour les enfants puisque le logement est petit. [ 9 ] La mère est à la recherche d’un milieu de vie plus grand et fait des démarches afin de stabiliser sa situation financière.
[ 10 ] La mère bénéficie toujours de la présence d’un éducateur de milieu qui l’aide notamment dans l’encadrement et la routine des enfants. [ 11 ] L’enfant a fait de beaux progrès à l’école. Depuis qu’il prend le transport scolaire, il est généralement à l’heure à l’école, ce qui est positif pour lui. [ 12 ] La mère est en attente d’un suivi avec une intervenante du CLSC de son quartier. [ 13 ] Pour le moment toutes les parties sont en accord avec les mesures proposées.
La mère mentionne que la présence d’un éducateur l’aide beaucoup. [ 14 ] Le Tribunal estime que les mesures proposées sont dans le meilleur intérêt et le respect des droits de l’enfant et au surcroit, elles font l’objet de l’assentiment de tous. CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 15 ] GRANTS the Application; [ 16 ] DECLARES that the security and the development of the child are still compromised; AND IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY
SECTION 91 OF THE YOUTH PROTECTION ACT: [ 17 ] ORDERS that the child remain entrusted to his mother; [ 18 ] ORDERS that the child be supervised at all times and that he not have any contact with Mr.
C; [ 19 ] ORDERS that the child attend school regularly and on time; [ 20 ] ORDERS that the mother ensure that the child receive the appropriate services he needs, and that she follow-through with the recommendations of professionals, particularly in regards to his Autism diagnosis; [ 21 ] STRONGLY RECOMMENDS that the mother follow-through with the recommendations of her psychological assessment; [ 22 ] AUTHORIZES the Director of Youth Protection to exchange information with all treating professionals; [ 23 ] ORDERS that aid, counsel and assistance be provided to the child and his family; [ 24 ] ENTRUSTS the situation of the the child, X, to the Director of Youth Protection of the Centre intégré universitaire de santé et services sociaux (CIUSSS) A, who shall then see that the measures are carried out; [ 25 ] ORDERS the execution of the present judgment by any peace officer if necessary; [ 26 ] THE WHOLE for a period of six (6) months.
