St-West, Etobicoke, (Ontario) M8X 2Y5 défendeur en garantie ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] Par une demande judiciaire signifiée le 20 avril 2009, la demanderesse réclame 7 000 $ pour vice caché. L’audition a lieu le 21 février 2001. LES FAITS [ 2 ] La défenderesse 3463192 Canada inc. est une compagnie constituée en 1998 pour faire la vente de véhicules. Elle fait affaires sous le nom de Mega Mitsubishi.
Monsieur Nader Dorman, deuxième actionnaire, président et administrateur, représente la défenderesse à l’audition. [ 3 ] Le 24 janvier 2008, la défenderesse achète de Adessa Ottawa un GMC 2004, Yukon, gris dont l’odomètre indique 79 155 kms. Il est " greenlight ", ce qui signifie dans le milieu qu’il s’agit d’un véhicule en bonne condition (D-3 et DF-1).
Elle paie ce véhicule 23 493,75 $. [ 4 ] Le 31 janvier 2008, la défenderesse fait une inspection du véhicule : changer l’huile et le filtre, remplacer l’essuie-glace, remplacer le " hand brakes shoes " remplacer les pneus, le tout coûte 599,94 $ (D-6). [ 5 ] La demanderesse et son fils s’intéressent à ce véhicule. Les parties s’entendent sur le prix de 24 970 $ plus 2 980 $ pour la garantie prolongée, plus les taxes (P-1). Le financement est assuré par Canada Trust. La demanderesse verse un acompte de 5 100 $ et le solde sera acquitté par 59 versements de 546,82 $ (P-4).
La demanderesse prend possession du véhicule le 4 février 2008. Le fils de la demanderesse trouve que le véhicule vibre lorsqu’il dépasse 100 km/h.
La défenderesse lui suggère un alignement des roues mais cela ne semble pas régler le problème. [ 6 ] Le 5 novembre 2008, le fils de la demanderesse consulte la Used Car Dealers Association of Ontario (UCDA) qui lui fournit les informations suivantes (P-4) : " Accident Indicator : Report Date : 12/4/2006 12:00:00 AM ; Point of Impact: Left Front Fender ; Estimated Amount 4397.00; Date of Loss : 2006-11-30 ; " [ 7 ] Le 10 février 2009, la demanderesse déclare avoir consulté un certain Khalid Ahed qui lui aurait dit que " l’appraised value " du véhicule accidenté serait de 8 900 $ (P-2). [ 8 ] L’odomètre indique alors 104 759 km alors qu’à l’achat il indiquait 79 194 km, donc 25 565 km de plus. [ 9 ] Le 13 février 2009, elle aurait aussi consulté un certain Janan Behnam qui lui aurait dit que " l’appraised value " serait de 9 500 $.
Ces personnes n’ont pas témoigné (P-2). [ 10 ] Le 20 février 2009, la demanderesse envoie à la défenderesse une lettre faisant état des démarches pour annuler la vente (P- 3) :
" Please find enclosed an accident report indicating the vehicule that I purchased on February 4, 2008 was previously in an accident. This was not stated on the contract upon purchasing the vehicle nor was there any mention that the car was previously in an accident. While driving the vehicle on the highway I noticed that the wind can be heard coming from the driver’s door. Also, if driving over 100 Km/h, the car will shake until the speed is reduced to less than 100 km.
I have completed 2 Alignment tests with Mega Mitsubishi and was told the vehicle passed on both occasions yet I noticed no improvement and the vehicle would still bear to the right when driving. Because of the defects in the car I decided to investigate the cause of the problems and found an accident report indicating the vehicle had been in an accident with an impact on the left front fender estimated at $4,397. A total amount of $4,397 is exceptionally high for damages on a fender which may indicate other parts of the car were damaged at the same time.
This would explain the problems I was having with the vehicle. When this was discovered, I immediately proceeded to discuss the situation with the owner at Mega Mitsubishi. I was told that the vehicle had never been in an accident and after many tests, the dealership could not find any problems with the vehicule, yet I had experienced the defects while driving and had an accident report on hand as proof of the accident. I then requested for my contract to be cancelled and all money paid for the vehicle to be returned since I was not informed of the defect(
s) in the vehicle. The merchant would not simply return the vehicle ; he had indicated that he would only be able to exchange the vehicle for another on the lot. I did not agree with this because I no longer trust company and no longer trust that the other vehicles are accident free. Ultimately, I wish to return the vehicle along with cancelling the contract and would also like all payments made to be returned back. I have attached a copy of all required documents including the contract, accident report and receipts.
I you have any questions, please contact my son, Jaafar Rashid, (…) " . [ 11 ] Le 15 février 2009, la défenderesse par M. Ron Lavoie, déclare que le rapport UCDA est peu crédible (D-8) : "The vehicle in question was purchased from G.M.A.C. This vehicle as well as all other vehicles purchased by our company are purchased on a " GREEN Light " . This signifies that there are no accidents [DECLARED] and no other declarations on the vehicle. A copy of our agreement with G.M.A.C. is included with this correspondence. Naturally the seller is responsible for the vehicle inspection.
In this case ADESA dealer auction and G.M.A.C. Prior to the delivery Mega inspected the vehicle and had Ont. safety check completed. The emission test was also completed at this time as required by law. Mr. Al-Fahdli purchased the vehicle February 4 th , 2008, and drove the 04 GMC Yukon over 14,000 kms. During the meeting between Mr. Dormani and Mr. Al-Fahdli, Mr. Dormani offered to provide a courtesy vehicle while Mega’s service checked the Yukon for any sign of an accident. Mr. Al-Fahdli refused. Eventhough Mr. Dormani and Mr.
Al-Fahdli together tried to find some evidence of paint work, structural or other visible damage, they both could not. Obviously there is no question as to integrity of the frame and chassis. Mr. Dormani’s impression at that time, was that the buyer had an issue because of the high gas consumption of this particular vehicle and offered to take the 04 Yukon on trade with another in stock vehicle. Mr. Al-Fahdli again refused to consider this offer. Please keep in mind that the auto check report is not an accident report !!
There is no repair order outlining what work, what parts or what labor costs were actually ever completed if ever. The accuracy of this type of report is questionable at best. We wish to maintain an excellent relationship with all of our clients and endeavour to do so through sound business ethics and practices. We will take the vehicle that Mr. Al-Fahdli originally purchased, 04 GMC Yukon on a trade-in situation but at an appraised value reflecting the actual distance traveled, age and overall condition in realtime.
It is common knowledge that since last spring the market value of all V8 vehicles have drastically been reduced due to the high price of gasoline. Therefore, Mr. Al-Fahdli’s request for a full refund is totally unreasonable". [ 12 ] Le 26 mars 2009, la demanderesse intente son action réclamant une réduction du prix de 7 000 $ ce qui signifie que le prix d’achat serait de 17 970 $. [ 13 ] La défenderesse déclare que " the value of the vehicle is according to the purchase price by Mega $23,493.75 + financing and taxes. The vendor Mega bought said truck from G.M.A.C.
Canada who declared that there was no accident to said truck". [ 14 ] La défenderesse en garantie conteste la demande en garantie pour les raisons suivantes : • " When 3463192 Canada Inc. purchased the 2004 Yukon vehicle on January 24, 2008 at the Adesa Ottawa auction, it agreed to the following conditions as appears from the sale contract that is filed as Exhibit DF-1 : " Buyer and seller expressly understand and agree that the terms and conditions set out in the Auction’s Policies and Arbitration Rules in effect on today’s date, the contents of which are well-know to the undersigned, form an integral part of this transaction and are binding upon the undersigned, our successors and assigns.
" • The Adesa’s Auction Policies and Arbitration Rules state that any application for arbitration must be completed within a maximum of seven (7) days following the receipt of the vehicle by the buyer, the whole as appears from the said rules (see page 23) that are filed as Exhibit DF-2 ; • In any event, the principal Plaintiff is not entiled to any damages because he did not suffer any damages, having travelled over 25 000 kilometres with the vehicle he purchased in less than thirteen months.
For these reasons, the action of 3463192 Canada Inc., carrying on business under the name of Mega Mitsubishi, aginst GMAC Leaseco Corporation is unfounded and should be dismissed " .
[ 15 ] La directrice générale de Adesa Ottawa, Mme Johanne Marzsin produit le témoignage suivant (D-4) : "(…) be advised that Mr. Nadar Dormani has been a dealer in the automotive business for over twenty years. As a registered dealer with the former Ottawa Auto Dealers Exchange from 1990 and with ADESA Auctions Ottawa (a division of ADESA Auctions Canada Ltd.) since being purchased in 1993, Mr. Dormani is recognized like few others in this business. Mr. Dormani is respected by auction facilities throughout North America and known for his no nonsense approach of doing business.
He is personally considered a most honorable and reputable individual who buys only green light vehicles. All vehicles must be free of liens a/o declarations of any kind. Mr. Dormani wears his honor on his sleeve, he has shown reputation means everything in business and next to family is the most important aspect of life.
There are few people connected with the Auction industry who commands such respect and it is my privilege on behalf of Adesa Auctions Ottawa and staff to provide such letter of reference for your consideration". [ 16 ] La défenderesse produit des exhibits du " Black Book " de janvier 2008, indiquant que le prix pour un 2004 GMC Yukon catégorie " average " est de 23 900 $ (D-7) et le prix en avril 2009 est de 20 150 $ (D-9).
Il note que le prix avait beaucoup baissé en avril 2009 parce que " it is common knowledge that since last spring the market value of all V8 vehicles have drastscally been reduced due to the high price of gazoline ". ANALYSE ET MOTIFS [ 17 ] Il s’agit de la vente d’une automobile d’occasion par un commerçant. Les automobiles d’occasion sont réparties en quatre catégories en vertu de la
Loi sur la protection du consommateur (L.R.Q. c. P-40.4) a. 60 ) :
a) « une automobile est de la catégorie A lorsqu’au plus deux ans se sont écoulés depuis la date de la mise sur le marché, par le fabricant, de ses automobiles du même modèle et de la même année de fabrication jusqu’à la date de la vente ou de la location à long terme visée audit article, pourvu que l’automobile n’ait pas parcouru plus de 40 000 kilomètres ;
b) une automobile est de la catégorie B lorsqu’elle n’est pas visée dans le paragraphe
a) et qu’au plus trois ans se sont écoulés depuis la date de la mise sur le marché, par le fabricant, de ses automobiles du même modèle et de la même année de fabrication jusqu’à la date de la vente ou de la location à long terme visée audit article, pourvu que l’automobile n’ait pas parcouru plus de 60 000 kilomètres ;
c) une automobile est dans la catégorie C lorsqu’elle n’est pas visée dans les paragraphes
a) ou
b) et qu’au plus cinq ans se sont écoulés depuis la date de la mise sur le marché, par le fabricant, de ses automobiles du même modèle et de la même année de fabrication jusqu’à la date de la vente ou de la location à long terme visée audit article, pourvu que l’automobile n’ait pas parcouru plus de 80 000 kilomètres ;
d) une automobile est dans la catégorie D lorsqu’elle n’est visée dans aucun des paragraphes a),
b) ou c) ». [ 18 ] Au 10 février 2009, soit un an après la vente, l’odomètre indiquait 104 759 kms. Il s’agit donc d’une automobile d’occasion qui tombe dans la catégorie D. La demanderesse ne peut donc invoquer la garantie de bon fonctionnement de l’article 159 L.P.C. [ 19 ] Elle veut cependant invoquer l’obligation de durabilité de l’article 38 L.P.C. qui édicte : « 38.
Un bien qui fait l'objet d'un contrat doit être tel qu'il puisse servir à un usage normal pendant une durée raisonnable, eu égard à son prix, aux dispositions du contrat et aux conditions d'utilisation du bien ». [ 20 ] Cette garantie légale s’applique aux biens usagers comme en l’espèce. Cette garantie est d’ordre public et ne peut être écartée par une exclusion conventionnelle. Il s’agit d’une application particulière de la notion de vice caché.
Le consommateur a le fardeau de prouver que l’absence de durabilité raisonnable provient d’un vice caché antérieur à la vente. [ 21 ] En l’espèce, la demanderesse déclare que " if driving over 100 km/h, the car will shoke until the speed is reduced to less than a 100 km/h ". [ 22 ] Cette version est contestée par la défenderesse. À cet égard, il faut appliquer l’
article 2803 du Code civil du Québec qui édicte : « 2803. Celui qui veut faire valoir un droit doit prouver les faits qui soutiennent sa prétention. Celui qui prétend qu'un droit est nul, a été modifié ou est éteint doit prouver les faits sur lesquels sa prétention est fondée ». [ 23 ] La demanderesse n’a produit aucun garagiste qui établirait le bien fondé de sa prétention.
Les documents de Khalid Ahed et Jonan Beham qui se ressemblent beaucoup, dont on ignore la formation et qui n’ont pas témoigné à la Cour doivent être rejetés parce qu’ils constituent du oui-dire et n’offrent aucune crédibilité. [ 24 ] Le témoignage de l’ingénieur Dormani apparaît beaucoup plus probant. [ 25 ] Le véhicule de la demanderesse a parcouru 25 565 kms entre le 4 février 2008 et le 10 février 2009 et elle n’a produit aucun document de garagiste établissant l’entretien ou une réparation quelconque. [ 26 ] Par ailleurs, le Tribunal retient les arguments contenus dans la lettre de la défenderesse de Ron Lavoie (D-8) : " The auto check report is not an accident report.
There is no repair order outlining what work, what parts or what labor costs were actually ever completed if ever. The accurary of this type of report is questionnable " .
PAR CES MOTIFS, LE TRIBUNAL : REJETTE la réclamation. Chaque
