Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on July 4, 2019. [ 2 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de prolonger son ordonnance rendue le 23 mai 2018. [ 3 ] Plus spécifiquement, elle demande de confier X (13 ans) a sa grand-tante maternelle jusqu’à sa majorité le [...] 2023 et qu’un suivi social soit offert à la famille. [ 4 ] L’enfant, par la voix de son avocate, est en accord avec les mesures proposées.
Il mentionne être bien chez sa grand-tante, il s’y sent en sécurité et désire y demeurer. [ 5 ] Les parents font certaines admissions et sont en accord avec les mesures proposées. CONTEXTE, ANALYSE ET DÉCISION [ 6 ] La sécurité et le développement de l’enfant sont déclarés compromis le 23 mai 2018 pour risque sérieux de négligence et abus psychologique. L’enfant est depuis confié à sa grand-tante maternelle.
[ 7 ] La situation des parents n’a pas évolué depuis la dernière ordonnance. Tous deux demeurent aux prises avec leurs difficultés personnelles. Quoique chacun d’eux accepte de participer à certains programmes, rien de substantiel n’est fait. [ 8 ] La collaboration des parents au suivi social demeure inconstante. [ 9 ] L’enfant voit sa mère régulièrement, lorsqu’elle vient au domicile de la tante maternelle, mais aucune activité n’est organisée par la dyade. [ 10 ] Quant au père, l’enfant refuse toujours tout contact avec ce dernier.
Il a même refusé de recevoir une carte de Noël contenant de l’argent provenant de lui. [ 11 ] Le père est attristé par la situation, il aimerait reprendre contact avec son fils et demeure disponible pour lui, toutefois, il accepte et respecte le désir de ce dernier. [ 12 ] Un travail est fait auprès de l’enfant afin de lui permettre de renouer avec son père. [ 13 ] L’enfant se développe bien chez sa grand-tante maternelle, il bénéficie d’un milieu de vie stable et sécuritaire.
Cependant, il peut par moment se montrer colérique et impulsif envers cette dernière lorsqu’il est contrarié. [ 14 ] Des services d’un éducateur ont été mis en place afin d’épauler la grand-tante dans ses interventions auprès de l’enfant. Cela est positif et doit être maintenu. [ 15 ] Au plan scolaire, aucune difficulté particulière n’est notée, l’enfant a un bon comportement et des résultats académiques satisfaisants. [ 16 ] L’enfant exprime vouloir rester confié à sa grand-tante maternelle, et ce, jusqu’à sa majorité.
Il y est avec son grand-frère avec qui il a une excellente relation. [ 17 ] La grand-tante maternelle mentionne au Tribunal vouloir s’investir dans la vie de l’enfant jusqu’à la majorité de ce dernier. [ 18 ] Le Tribunal estime que la sécurité et le développement de l’enfant sont toujours compromis et que les mesures proposées sont dans son meilleur intérêt et le respect de ses droits. CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 19 ] GRANTS the Application; [ 20 ] DECLARES that the security and development of the child are still compromised; AND IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY
SECTION 91 OF THE YOUTH PROTECTION ACT: [ 21 ] ORDERS that the child remain entrusted to the foster home of his maternal great aunt, Ms C; [ 22 ] ORDERS that the frequency and modality of contacts between the child and his parents be determined by the Director of Youth Protection, including supervision if deemed necessary and in respect with child’s wishes; [ 23 ] ORDERS that the child receive therapeutic services and follows the recommendations of the treating professionals; [ 24 ] STRONGLY RECOMMENDS that the family receive the services of an educator, as long as deemed necessary; [ 25 ] AUTHORIZES the Director of Youth Protection to exchange information with treating professionals working with the family; but in regards of the therapeutic follow-up of the child, only pertaining his presence and participation and to keep the content confidential; [ 26 ] RECOMMENDS that the mother undergo a psychological assessment and follow the recommendations; [ 27 ] ORDERS that aid, counsel and assistance be provided to the child and his family; [ 28 ] ENTRUSTS the situation of the child, X, to the Director of Youth Protection of the Centre intégré universitaire de santé et services sociaux (CIUSSS) A, who shall then see that the measures are carried out, and these measures may be executed by any peace officer if necessary; [ 29 ] THE WHOLE until the age of majority of the child, [...], 2023.
