Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on May 25, 2018. [ 2 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de prolonger son ordonnance rendue le 3 octobre 2017. [ 3 ] Plus spécifiquement, elle demande de confier X (1 an) en famille d’accueil soit celle de sa tante maternelle, madame C, et qu’un suivi social soit offert à la famille pour une période de neuf (9) mois.
La Directrice prépare l’élaboration d’un projet de vie pour l’enfant et entend présenter une demande de tutelle. [ 4 ] L’enfant, par la voix de son avocat, est en accord avec les mesures proposées. [ 5 ] Les parents, quoique dûment signifiés, sont absents lors de l’audition. CONTEXT [ 6 ] La sécurité et le développement de l’enfant sont déclarés compromis le 3 octobre 2017 pour risque sérieux de négligence. L’enfant est depuis confié à sa tante maternelle. ANALYSIS OF THE EVIDENCE AND DECISION
[ 7 ] Depuis la dernière ordonnance, la situation des parents est au statu quo . Leurs difficultés personnelles demeurent inchangées, aucun progrès n’est noté. [ 8 ] Les parents sont peu présents dans la vie de l’enfant. Ils ne sont pas assidus dans leurs contacts avec lui. [ 9 ] La mère a manqué la majorité des rencontres prévues avec son fils. Sa participation au suivi social est nulle et elle est difficilement joignable. [ 10 ] La mère refuse de donner ses coordonnées personnelles.
Il est très difficile de pouvoir entrer en contact avec elle et d’obtenir son autorisation pour les différents besoins de l’enfant. [ 11 ] La situation du père est identique. [ 12 ] L’enfant quant à lui se développe bien auprès de sa tante maternelle. Il vit avec son frère et a des contacts réguliers avec le reste de sa fratrie qui vit auprès de son autre tante. [ 13 ] Il obtient réponse à tous ses besoins. La tante a fait les démarches avec la Directrice afin que l’enfant puisse obtenir son statut A. [ 14 ] Un lien significatif se crée entre l’enfant et sa tante, auprès de qui ce dernier a passé la majeure
partie de sa vie. [ 15 ] La preuve démontre que les parents sont peu investis dans la vie de leur fils, cela est à l’image de l’implication qu’ils ont avec leurs 5 autres enfants. [ 16 ] La tante maternelle mentionne que la mère a vu l’enfant uniquement à deux reprises depuis Noël et que l’enfant ne reconnait pas sa mère. Il n’a aucun lien avec elle. [ 17 ] La tante agit déjà depuis 8 ans à
titre de tutrice pour le frère de l’enfant. Elle est prête à s’investir dans la vie de ce dernier à long terme. [ 18 ] Le Tribunal estime que la sécurité et le développement de l’enfant sont toujours compromis et que les mesures proposées correspondent au meilleur intérêt de l’enfant. [ 19 ] Une possible reprise en mains des parents apparaît peu probable au Tribunal. Les prochains mois devront servir à la Directrice à élaborer un projet de vie pour l’enfant. CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 20 ] GRANTS the present demand; [ 21 ] DECLARES that the security and the development of the child are still compromised; AND IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY
SECTION 91 OF THE YOUTH PROTECTION ACT: [ 22 ] ORDERS that the child be entrusted to the foster home of his maternal aunt, Mrs. C; [ 23 ] ORDERS that the frequency and modality of contacts between the child and his parents be determined by the Director of Youth Protection; [ 24 ] WITHDRAWS to the parents the exercise of the attributes of parental authority in regards to signing consents for the child; [ 25 ] AUTHORIZES the maternal aunt, Mrs.
C, to sign the consents for the child in regards to travel, medical and social needs, registering the child regarding First Nations Status and applying for passport; [ 26 ] RECOMMENDS that both parents refrain from being under the influence of all substances in presence of the child; [ 27 ] ORDERS that the parents undergo random drug testing upon requested by the Director of Youth Protection; [ 28 ] RECOMMENDS that both parents actively participate and complete a program to address their substance abuse issues; [ 29 ] RECOMMENDS that the parents stabilize their situation and report back to the Director of Youth Protection as to their progress; [ 30 ] ORDERS that the parents inform the Director of Youth Protection of any changes regarding their contact details (address, telephone number) within the least possible delay; [ 31 ] AUTHORIZES the Director of Youth Protection to receive and obtain information from the treating professionals; [ 32 ] ORDERS that an extract of the judgment be sent by the court clerk to the maternal aunt, Mrs.
C in regards of the exercises of the attributes of the parental authority; [ 33 ] ORDERS that aid, counsel and assistance be provided to the child and his family; [ 34 ] ENTRUSTS the situation of the child, X to the Director of Youth Protection of the Centre intégré universitaire de santé et services sociaux (CIUSSS) A, who shall then see that the measures are carried out; [ 35 ] THE WHOLE for a period of nine (9) months.
