[ 1 ] Le Tribunal est saisi d'une demande en révision d'une ordonnance rendue par le soussigné le 14 juin 2018. [ 2 ] La mère s’occupe bien de l’enfant.
Son domicile est adéquat. X évolue bien. Le Directeur n’a plus d’inquiétude quant aux aptitudes de madame A. [ 3 ] La situation de monsieur B est tout autre. En août 2018, il est recherché par la police. En novembre, il est arrêté pour fraude et blanchiment d’argent. En février, il subit un arrêt cardiaque. [ 4 ] Depuis lors, il refuse toute collaboration avec le Directeur malgré les nombreux accommodements proposés. [ 5 ] Par exemple, monsieur B exige des rencontres à Ville A.
Il demande que les contacts avec son fils y aient lieu malgré les déplacements importants que ça impose à X. [ 6 ] Depuis le 18 février, les contacts sont suspendus jusqu’à ce que le père reprenne sa collaboration avec le Directeur, ce qu’il refuse de faire. [ 7 ] À l’audition du 27 mai, il prend, de peine de misère, l’engagement de rencontrer l’intervenante 2 fois pour faciliter la reprise des contacts. [ 8 ] On apprend aujourd’hui qu’il ne s’est pas conformé à son engagement. Il a manqué 2 rendez-vous sans raison apparente.
De plus, il est absent de l’audition. [ 9 ] Il y a donc lieu de circonscrire très rigoureusement les contacts père/fils. Rappelons que X est attaché à son père et qu’il désire le voir.
FOR ALL THESE REASONS, THE COURT : [ 10 ] DECLARES that security and development of X are still compromised; [ 11 ] ENTRUSTS the situation of the child to the Director of Youth Protection of the CIUSS A, who shall then see that the measures are carried out: [ 12 ] ENTRUSTS X to the mother; [ 13 ] AUTHORIZES the mother to keep her address and the school’s address confidential to the father; [ 14 ] ORDERS that contacts between the child and his father take place under the direct supervision of the Director at a frequency to be agreed upon between the parties, failing an agreement, the frequency will be once every 2 months;
[ 15 ] THESE CONTACTS will be conditional to the father’s sobriety at the time of the said contacts and to the father’s respect of the Director confirmation modalities; [ 16 ] RECOMMENDS that the father take
part in a program to address his drug issues; [ 17 ] ORDERS the parents to collaborate with the Director of Youth Protection; [ 18 ] ORDERS that aid, counsel and assistance be provided to the child and his parents; [ 19 ] THE WHOLE for 9 months.
