The following is the judgment delivered by THE COURT [ 1 ] The moving party, the Registrar of the Court of Appeal of New Brunswick, seeks an order by way of motion, dismissing the appeal pursuant to Rule 62.24 of the Rules of the Court for failure to comply with Rule 62.15(1). [ 2 ] The Registrar also seeks an order under Rule 2.01 dispensing with service on the Appellant of the Notice of Motion and affidavit in support.
