Counsel at hearing: For the appellant: No one appeared For the respondent: Patrick McGuinty THE COURT The application for leave to appeal both conviction and sentence is dismissed. The following is the judgment delivered by THE COURT (Orally) [ 1 ] On July 16, 2019, Kenneth Nowlan-Ward was convicted of assault with a weapon ( s. 267 (
a) of the Criminal Code ) and, on October 15, 2019, he was sentenced to imprisonment for six months. [ 2 ] Mr. Nowlan-Ward wishes to appeal both conviction and sentence. Since none of the grounds raised allege an error of law, he requires leave: Criminal Code , s. 675(1) (a)(ii) and s. 675(1) (b). [ 3 ] Essentially, Mr. Nowlan-Ward asks us to make fresh findings of credibility and fact, which would amount to us retrying the case. As we have often stated, that is not our role.
Such findings are entitled to deference and may not be overturned unless the result of a palpable and overriding error. [ 4 ] Having reviewed the record, we conclude there would be no reasonable prospect of success on appeal if leave were granted. This is so in regard to both conviction and sentence. As a result, the application for leave to appeal is dismissed.
