Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Court is seized of a petition under
section 38 of the Youth Protection Act , introduced by the Director of Youth Protection, for the purposes of declaring that the security and the development of the child are considered to be in danger for the following reasons: - The child is subjected to psychological ill-treatment since he is exposed to violence between his parents that is caused by his father; [ 2 ] In support of his recommendations, the attorney for the Director of Youth Protection submits a report (D-1) prepared by the declarant, Mrs. Social Worker 1. [ 3 ] The mother is present and gives her consent to the conclusions of the report.
The father is absent and it is impossible to reach him because he is on the run since the last event of violence toward the mother. [ 4 ] The attorney for the child gives her consent to the conclusions of the report. [ 5 ] Given the evidence submitted and the consents expressed. [ 6 ] THEREFORE THE COURT : [ 7 ] GRANTS the petition; [ 8 ] DECLARES that the security and the development of the child are compromise for the motives alleged in the said petition; [ 9 ] ORDERS that the child X be entrusted to his mother without the presence of the father; [ 10 ] ORDERS that the contacts between the father and the child be according to the modalities and supervised by a person designated by the Director of Youth Protection, as long as deemed necessary; [ 11 ] ORDERS that the father receive services of anger management; [ 12 ] ORDERS that the mother receive services for her situation of victim of conjugal violence; [ 13 ] ORDERS that the parents participate actively in the elaboration and the application of the intervention plan; [ 14 ] ORDERS that a person working for the CENTRE DE JEUNESSE A offers help, advice and assistance to the family and the child for a period of one year;
[15] ENTRUSTS the situation of the adolescent to the Director of Youth Protection of the CENTRE DE JEUNESSE A who shall then see that the measures are carried out. __________________________________ MICHEL SÉGUIN, J.C.Q .
