L. ; and LE CURATEUR PUBLIC DU QUÉBEC ; Mis en cause ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] JL 3645 CONSIDERING the motion to institute proceedings to obtain an order of the Court for a temporarily confinement in an institution to proceed to psychiatric assessment; [ 2 ] CONSIDERING the report from D r Jacques Morin, psychiatrist, dated of May 17, 2012, concluding to the necessity of a temporarily confinement of the Defendant; [ 3 ] CONSIDERING that the defendant is a danger to himself regarding to his mental state; [ 4 ] CONSIDERING the impossibility to proceed to the psychiatric assessments of the Defendant within the seventy-two (72) hours of the preventive confinement, as it is required under

section 7 of the A ct respecting the protection of persons whose mental state presents a danger to themselves or to others ; [ 5 ] CONSIDERING it is required to proceed to the Defendant’s psychiatric assessments following the law, in order to verify if a motion to obtain a confinement in an institution is necessary;

[ 6 ] CONSIDERING that the defendant refuses to be confined in an institution; [ 7 ] CONSIDERING the proof that was presented at the hearing; [ 8 ] CONSIDERING the statement of the defendant; [ 9 ] CONSIDERING the urgency of the situation and all the circumstances; FOR THESE REASONS, MAY IT PLEASE THE COURT: [ 10 ] GRANT the present motion; [ 11 ] SHORTEN the delay for service and presentation of the present motion; [ 12 ] ORDER to J. F., the Defendant, to be placed temporarily under confinement in Centre de santé et de services sociaux de Rouyn-Noranda for the required time to submit J.

F. to psychiatric assessments, and if it is appropriate, the presentation of a motion to obtain the confinement in an institution ; [ 13 ] Consequently, CONFINE J.

F., the Defendant, to Centre de santé et de services sociaux de Rouyn-Noranda; [ 14 ] AUTHORIZE, IN CASE OF REFUSAL, the peace officers or the paramedics to assist the Plaintiff or anyone who is involved in this Court order, on their verbal request, if assistance is needed for the execution of this order because the Defendant, wherever she is, would not conform to this order; [ 15 ] ORDER to Centre de santé et de services sociaux de Rouyn-Noranda to file the reports with the Court within seven (7) days of this Court order; [ 16 ] ORDER THE NOTIFICATION of the judgment to the Defendant and to the mis en cause ; [ 17 ] THE WHOLE without costs. __________________________________ RENÉE LEMOINE, J.Q.C.
