The following is the judgment delivered by THE COURT [ 1 ] On December 21, 2010, a judge of the Court of Queen’s Bench convicted Peter Joseph Guy Monteith of robbery, an offence set out in s. 343 (
b) of the Criminal Code , for which he was sentenced to serve 5 years imprisonment. [ 2 ] Mr. Monteith appeals from his conviction pursuant to s. 675(1)( a )(
i) and seeks leave to appeal conviction and sentence pursuant to ss. 675(1)( a )(ii) and 675(1)(
b) respectively. [ 3 ] There is no merit to the appeal based upon any ground of appeal that involves a question of law alone. Mr. Monteith’s application for leave to appeal from conviction based upon a question of fact or mixed law and fact is denied. Similarly, his application to appeal against sentence is denied.
