Section 95 of the Youth Protection Act , C.Q.L.R., c. P-34.1) ______________________________________________________________________ WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified.

Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Director of Youth Protection submits a motion to review and extend a Court decision rendered on November 7, 2017, ordering the placement of X in a rehabilitation centre for a period of one year. [ 2 ] For the hearing, the teenager is present and represented by Mtre Yan Massé. The mother is not present, but she is represented by Mtre Marie-Josée Ayoub. The father is present, but is not represented by counsel.

The motion is not challenged. [ 3 ] The evidence reveals that X was reintegrated to his father’s care until December, when provisional measures were taken ordering that X be placed in a reception centre until January 9, 2019. [ 4 ] To this day, X still displays behavioural disturbances. He does not attend school regularly, he consumes marijuana. He sometimes does not respect the curfew at his father’s place or kept his father unaware of his whereabouts. [ 5 ] X really wants to receive services in order to improve his situation. The father wants the best for his son. He cares about him a lot.

He would also like the mother to be more involved in X’s life. He stated to the Court that the communication between the mother and him has improved. [ 6 ] The parties recommend to the Court that X be placed in a reception centre for a period of one year with a possible reintegration in a foster family at the end of the school year if the situation allows it. [ 7 ] All the other measures recommended by the Director of Youth Protection are agreed upon by the parties.

FOR THESE MOTIVES, THE COURT: [ 8 ] GRANTS the motion; [ 9 ] MAINTAINS that to this day, the security and development of X are still endangered; [ 10 ] ORDERS the placement of X in a reception centre for a period of one year with a possible reintegration in a foster family at the end of the school year if the situation allows it; [ 11 ] ORDERS that aid, counselling and assistance be provided to the family for a period of one year; [ 12 ] ORDERS X to attend school on a regular basis;

[ 13 ] ORDERS that services be provided to X in order to resolve any problems regarding drugs and alcohol consumption and ORDERS X to actively participate to these services; [ 14 ] ORDERS both parents to seek help in order to improve their parental skills; [ 15 ] ORDERS both parents to seek treatment regarding their alcohol and drug consumption issues; [ 16 ] RECOMMENDS that the mother be more involved in X’s life; [ 17 ] ORDERS that access rights be supervised by the Director of Youth Protection as for the frequency and the modalities; [ 18 ] ORDERS any peace officer to collaborate to the execution of the Court orders if requested to do so by the Director of Youth Protection or one of its representatives; [ 19 ] ENTRUSTS the situation of X, born on [...], 2003, to the Director of Youth Protection for the execution of the Court orders.
