SYNDICAT DES PROFESSEURES ET DES PROFESSEURS DE L’UNIVERSITÉ DU QUÉBEC EN OUTAOUAIS – CSN UNIVERSITÉ DU QUÉBEC EN OUTAOUAIS RESPONDENTS – Defendants and ATTORNEY GENERAL OF QUEBEC IMPLEADED PARTY – Impleaded party JUDGMENT [ 1 ] The two respondents have seized the Court of motions to dismiss the appellant’s appeal on the ground that it has no reasonable chance of success. [1] [ 2 ] The appellant sought to appeal against a decision of the Superior Court [2] to dismiss his originating application asking the Court to find bad faith and discriminatory obstruction on the part of the respondents in his efforts to file a grievance as provided in the collective agreement, seeking the appointment of an arbitrator in the matter as well as $100,000 in damages.

The Superior Court affirmed that

section 47.5 of the Labour Code [3] grants exclusive jurisdiction to the Administrative Labour Tribunal to authorise the Minister of Labour to appoint an arbitrator should it conclude that the certified association acted contrary to

section 47.2 of the Labour Code . The Tribunal made no such order in the present case and the Superior Court concluded that no exception is applicable in the present case that would permit civil proceedings in that court. [4] [ 3 ] The appellant fails to identify any error in this matter that would justify the Court’s intervention and accordingly the appeal has no reasonable chance of success.
