[2] As stated by Stratton C.J.N.B. in University of New Brunswick Student Union Incorporated etal. v. Smith (S.) et al; University of New Brunswick Student Union Incorporated et al. v. Vaillancourt et al. (1987), (NB CA), 84 N.B.R. (2d) 292, [1987] N.B.J. No. 804 (QL) (C.A.): […] Our task in respect of the present motions is not to determine the appeals but rather to decide if the appeals are frivolous, vexatiousor without grounds.
Black’s Law Dictionary (5th Ed.), defines a frivolous appeal as one in which no justiciable question has beenpresented and the appeal is readily recognizable as devoid of merit in that there is little prospect that it can ever succeed. The sameauthority defines vexatious proceedings as those instituted maliciously and without probable cause. And we would underline that it haslong been settled that the court’s jurisdiction to dismiss a suit as frivolous or vexatious is to be used sparingly and only in cases
which are clear and beyond doubt. [Emphasis added; para. 3] [3] In the present matter, we are not satisfied this case meets the necessarily high thresholdimposed for dismissing an appeal as being frivolous, vexatious or without grounds. Accordingly, the motion is dismissed. [4] Costs are left to be determined by the panel hearing the appeal.

Smith (S.) et al; University of New Brunswick Student Union Incorporated et al. c. Vaillancourt et al. (1987), (NB CA), 84 R.N.-B. (2e) 292, [1987] A.N.-B. no 804 (QL) (C.A.) : [TRADUCTION] […]
