VILLE DE MONTRÉAL Defendant ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] 9235400 Canada inc. (the Company) is claiming $3,140.66 from Ville de Montréal (the City) for damages to its tractor. [ 2 ] The City presents a Demand to have the Company’s action dismissed referring to
article 585 of the Cities and Towns Act [1] (CTA) . QUESTION IN ISSUE Is the failure by the Company to send the appropriate notice within 15 days fatal to its right of action? CONTEXT AND ANALYSIS [ 3 ] On February 4, 2016, while driving the tractor, the Company’s representative hit a pothole and damages ensued. [ 4 ] On March 6, 2016, the Company sent a notice to City of Côte St-Luc [2] . [ 5 ] On April 13, 2016, the Company sent a notice to City of Hampstead [3] . [ 6 ] On April 28, 2016, the Company sent a notice to the City [4] . [ 7 ] The Company’s representative explained that he had troubles finding the correct city to which the notice had to be sent. [ 8 ]
Article 585 of the Cities and Towns Act reads as follows: 585.
(1) If any person claim or pretend to have suffered bodily injury by any accident , for which he intends to claim damages from the municipality, he shall, within 15 days from the date of such accident, give or cause to be given notice in writing to the clerk of the municipality of such intention, containing the particulars of his claim, and stating the place of his residence, failing which the municipality shall be relieved from any liability for any damages caused by such accident, any provision of law to the contrary notwithstanding.
(2) In case of any claim for damages to property , movable or immovable, a similar notice shall also be given to the clerk of the municipality, within 15 days, failing which the municipality shall not be liable for any damages, any provision of law to the contrary notwithstanding. […]
(4) The failure to give such notice shall not, however, deprive any victim of such accident of his right of action, if he prove that he was prevented from giving such notice for any reason deemed sufficient by the court or judge. […]
(5) No action in damages shall lie unless such action be instituted within six months after the day on which the accident happened or the right of action accrued.
[…] (our underlining) [9] The definition of “accident” under CTA has been interpreted as covering negligence from a city linked to faulty maintenance[5]. [10] The circumstances described by the Company meet the definition of accident, being an enforceable and involuntary event. [11] The necessity to provide a notice within 15 days is a precondition to the right to sue the City. Une telle vérification permettra dedéterminer sa part de responsabilité dans les dommages subis, de recueillir des éléments de défense et de corriger la situation dangereuse.La nécessité d’un avis force les réclamants à agir avec diligence. Les municipalités qui administrent des fonds publics sur la base d’unbudget annuel ont le droit de connaître rapidement l’étendue de leurs obligations. Les avis, même s’ils ont parfois pour effet de limiter lespoursuites contre les municipalités, sont exigés principalement dans l’intérêt public.
Le but premier de l’avis de réclamation est de permettre à la municipalité de faire enquête en temps utile sur les circonstances del’accident prétendument causé par sa faute. […] [13] The Court of Appeal in Châteauguay (Ville de) c. Axa Assurances inc.[7] indicates: L’avis de réclamation prévu par l’article 585 n’est pas un délai de prescription mais constitue une condition d’ouverture préalable etessentielle au droit d’action, un véritable délai de déchéance.
Ce principe, d’abord énoncé par la Cour suprême dans Cité de Québec c.Baribeau, (SCC), [1934] R.C.S. 622, a par la suite été constamment repris par nos tribunaux. L’article 585 doit être interprété en fonction des buts visés par le législateur lors de son adoption. Cet avis est conçu afin d’informerla municipalité et lui permettre de conduire les enquêtes nécessaires pour vérifier dans un délai raisonnable le fondement de la demandeet les circonstances pouvant engager sa responsabilité.
Il a pour but de protéger les corporations municipales contre des réclamationstardives et abusives, de donner aux officiers accès aux personnes qui entendent réclamer des dommages, d’autoriser la visite despropriétés mobilières et immobilières pour lesquelles on réclame, de favoriser tout préliminaire de conciliation ou tentative de règlement,ou encore de préparer une contestation.
Les arrêts plus récents mettent davantage l’accent sur l’aspect de signalement, la possibilité et ledevoir de la municipalité de mettre en branle le processus d’enquête et se procurer les renseignements additionnels qu’elle souhaiteobtenir. […] Enfin, l’objectif de l’avis est de prévenir la municipalité pour qu’elle puisse vérifier les circonstances de l’événement et de l’étenduedu dommage subi par une personne identifiée. L’avis ne renvoie pas à la nature de la faute mais vise la connaissance de l’identité de lavictime, la nature de son préjudice et la valeur de sa perte.
Même si la planification incorrecte de travaux, par exemple, pouvait laisserprévoir qu’un jour ou l’autre des bris pourraient survenir, cela ne signifie généralement pas que l’on sait qui sera affecté, quand,comment et la valeur de son préjudice. Cela est encore confirmé par le contenu de l’avis : - l’expression de l’intention de poursuivre la municipalité; - les détails de la réclamation; - l’endroit de la résidence de la
partie demanderesse. (Citations omitted and underlining added) [14] No notice was given by the Company within the 15 days delay. [15] The ignorance of the law cannot justify the absence of notice[8]. [16] The fact that the Company was busy at that time of the year is not a reason deemed sufficient to establish that it was preventedfrom giving a proper notice. [17] The Court Quebec, Small Claim Division, is not a Court of equity[9]. FOR THESE REASONS, THE COURT: DISMISSES the action of Plaintiff 9235400 Canada inc. against Defendant Ville de Montréal; WITHOUT LEGAL COSTS. __________________________________ DOMINIQUE VÉZINA, J.C.Q
