Any person who contravenes this provision commits an offence and is liable to a fine. [ Y.P.A. sections 11.2.1 and 135 ] [ 1 ] The Court is seized of an Application filed pursuant to
Section 95 of the Youth Protection Act by a person duly mandated by the Director of Youth Protection ( the Director ) to revise the order rendered by the undersigned on May 30, 2019 whereby the child was entrusted to the foster home of Mrs. C and Mr. D until majority. At the same time, the father’s attributes of parental authority were withdrawn and attributed to the mother. [ 2 ] On November 1 st , 2019, the mother suddenly passed away.
As well, the father’s whereabouts have remain unknown and he has no involvement with the child. [ 3 ] Consequently, the Director is asking the Court to attribute signing power to the foster parents. [ 4 ] The Court proceeds in the father’s absence as he could not be located or informed of today’s hearing.
[ 5 ] The foster parents are present and agree with the present request, as does the child’s attorney. [ 6 ] CONSIDERING that the mother passed away; [ 7 ] CONSIDERING that the father is not involved with the child; [ 8 ] CONSIDERING that the child continues to do well with her foster parents; [ 9 ] CONSIDERING that the foster parents agree to sign consents regarding the child; [ 10 ] CONSIDERING the consent of the child’s attorney; [ 11 ] THE COURT DECLARES that the security or development of the child is still in danger; [ 12 ] ORDERS that the child remain entrusted to the foster home of Ms. C and Mr.
D; [ 13 ] ORDERS that the contacts between the child and her father remain suspended; [ 14 ] WITHDRAWS from the father the attributes of his parental authority to sign consents for the child’s medical needs, education, extracurricular activities, travel needs, applying for a passport and drivers’ license and AUTHORIZES the foster parents to sign said consents; [ 15 ] ORDERS a person working for the Centre intégré universitaire de santé et de services sociaux A to provide aid, counsel and assistance to the child and the family; [ 16 ] THE WHOLE UNTIL THE CHILD’S AGE OF MAJORITY, [...], 2034; [ 17 ] ENTRUSTS the situation of the child, X, to the Director of Youth Protection of the Centre intégré universitaire de santé et de services sociaux A for the purposes of the execution of this judgment; [ 18 ] ORDERS the execution of this judgement by any peace officer, if necessary; _______________________________________ CLAUDE LAMOUREUX, J.C.Q.
