LA COUR La demande d’autorisation d’interjeter appel de la déclaration de culpabilité et de la sentence est rejetée.
The following is the judgment delivered by THE COURT (Orally) [1] Robin Wade Blizzard pled guilty to possession of a firearm while prohibited by an order made under s. 109(2) of the Criminal Code and to violation of a probation order, offences set out in ss. 117.01 and 733.1 respectively. He seeks to appeal both the conviction and the sentence. To do so, Mr.
Blizzard must first obtain leave to appeal, because the withdrawal of a guilty plea raises a question of mixed law and fact for which leave is required under s. 675(1)( a )(ii) and leave to appeal sentence is necessary under s. 675(1)( b ). [2] A review of the record leaves no reason to doubt the validity of Mr. Blizzard’s pleas and no new evidence has been adduced to put the validity of those pleas in question. As a result, the application for leave to appeal conviction is dismissed.
As for the sentence, the total of 2.5 years of imprisonment imposed was the result of a joint recommendation, which the judge accepted. There would be no reasonable basis for any interference with such a sentence. Therefore, the application for leave to appeal the sentence is also dismissed.
