Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] Invoquant une situation de négligence sur le plan physique, la Directrice de la protection de la jeunesse demande au Tribunal de déclarer compromis la sécurité et le développement de X, âgée de 23 mois. À
titre de mesures, elle recommande de confier l’enfant à sa mère, tout en ordonnant un suivi social d’une durée de six mois. [ 2 ] La mère assiste à l’audience; elle reconnaît que la sécurité et le développement de sa fille sont compromis pour les motifs invoqués au soutien de la demande et consent aux mesures recherchées. [ 3 ] La filiation paternelle de l’enfant n’est pas légalement établie.
Depuis peu, B, qui serait son père biologique, s’occupe toutefois de l’enfant et soutient la mère. [ 4 ] Tel que l’admet la mère, l’enfant, qui est née prématurément, a un retard significatif de développement, tant sur les plans moteur que social et affectif. Elle a de la difficulté à ramper, à se tenir debout, à jouer, à répéter des sons et à être séparée de sa mère.
Elle a donc un grand besoin de stimulation. [ 5 ] Or, la mère a de la difficulté à suivre les recommandations des professionnels à cet égard; elle refuse que sa fille fréquente la garderie et a manqué plusieurs rendez-vous avec les professionnels du centre A . Toutefois, la situation, qui demeure tout de même fragile, s’est récemment améliorée depuis que le père biologique a décidé de soutenir à la fois la mère et l’enfant.
Les deux parents collaborent maintenant beaucoup mieux; ils font faire à l’enfant les exercices qui sont suggérés et sont maintenant plus proactifs en ce qui concerne les soins de santé dont la fillette a besoin. [ 6 ] Il est toutefois important que cette collaboration demeure et que les parents continuent à fournir à l’enfant toute l’attention et la stimulation dont elle a besoin. [ 7 ] Le Tribunal suggère enfin à monsieur B d’entreprendre les démarches nécessaires afin de faire établir légalement sa paternité. [ 8 ] Dans ces circonstances, le Tribunal n'a aucune hésitation à déclarer la sécurité et le développement de l’enfant compromis en raison d’une situation de risques sérieux de négligence et à faire droit aux mesures de protection suggérées qui, selon la preuve, sont appropriées à ses besoins.
[ 9 ] La demande est fondée; elle est dans l’intérêt de l'enfant et respecte ses droits. [ 10 ] POUR CES MOTIFS, LE TRIBUNAL : [ 11 ] ACCUEILLE la demande; [ 12 ] DÉCLARE la sécurité et le développement de l'enfant compromis; [ 13 ] ORDONNE l’exécution des mesures de protection suivantes :
a) Que l’enfant soit maintenue chez sa mère;
b) Qu’ une personne qui travaille pour un établissement ou un organisme du CISSS[A]/CJ[A] apporte aide, conseils ou assistance à l’enfant et à sa famille pour la période de six mois;
c) Que la mère participe activement à l'application des mesures visant à mettre fin à la situation de compromission, notamment en collaborant avec l'intervenante sociale dans le cadre de l'élaboration et de l'application du plan d'intervention;
d) Que l’enfant continue de recevoir les soins et services requis par son état de santé, afin de combler son retard de développement, et qui sont recommandés par les professionnels; [ 14 ] RECOMMANDE :
a) Que l’enfant fréquente une garderie; [ 15 ] CONFIE la situation de l'enfant à la Directrice de la protection de la jeunesse pour l’exécution de la présente décision. __________________________________ MARIE PRATTE, J.C.Q.

and A In her capacity as mother ______________________________________________________________________ JUDGMENT (section 38, Youth Protection Act ) ______________________________________________________________________ WARNING: The Youth Protection Act prohibits the publication or broadcast of information allowing a child or the child’s parents to be identified.
Every person who contravenes this provision is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [1] Invoking a situation of neglect from a physical standpoint, the Director of Youth Protection asked the Court to declare that the security and development of 23-month-old X are in danger. As measures, she recommended that the child be entrusted to her mother and that social follow-up be ordered for six months. [2] The mother attended the hearing.
She acknowledged that her daughter’s security and development were in danger for the reasons invoked in support of the application and consented to the measures sought. [3] The child’s paternal filiation is not legally established. However, B, the alleged biological father, recently began caring for the child and supporting the mother. [4] The mother admitted that the child was born prematurely and that she has significant developmental delays, both with regard to her motor skills and from a social and emotional standpoint.
The child has difficulty crawling, standing up, playing, repeating sounds and being separated from her mother. Therefore, she is greatly in need of stimulation. [5] The mother has difficulty following the recommendations of the professionals in that regard. She refused to have her daughter attend a daycare centre and missed several meetings with the professionals from the A centre. Although the situation remains fragile, it began improving recently when the biological father decided to support the mother and the child. Both parents are now much more cooperative. They have the child do the recommended exercises.
They are now more proactive with regard to the health care that the young girl needs. [6] However, it is important that the parents continue to cooperate and to provide the child with all the attention and stimulation she needs. [7] Lastly, the Court recommends to Mr.
B that he take the steps required to legally establish his paternity. [8] In the circumstances, the Court has no hesitation in declaring that the child’s security and development are in danger because of a serious risk of neglect and in allowing the proposed protective measures, which, according to the evidence, are suited to the child’s needs. [9] The application is founded; it is in the child’s interest and in keeping with her rights. [10] THEREFORE, THE COURT : [11] ALLOWS the application; [12] DECLARES that the child’s security and development are in danger; [13] ORDERS the execution of the following protective measures:
e) That the child be kept with her mother;
f) That a person working for a CISSS[A]/CJ[A] institution or body provide aid, counselling or assistance to the child and her family for six months;
g) That the mother actively participate in the application of the measures aimed at ending the situation of endangerment, particularly by cooperating with the social worker in the development and application of the intervention plan;
h) That the child continue to receive the care and services required by her state of health and recommended by the professionals, so that she can overcome her developmental delays; [14] RECOMMENDS:
b) That the child attend a daycare centre; [15] ENTRUSTS the child’s situation to the Director of Youth Protection for the execution of this decision. __________________________________ MARIE PRATTE J.C.Q.
