KYRKAS Mises en cause ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] Le Tribunal est saisi d’une requête des intimés suivant les articles 54.1 et suivants du Code de procédure civile [1] (C.p.c.) afin de faire déclarer un acte de procédure de l’appelant abusif ainsi que pour faire déclarer celui-ci plaideur quérulent. [ 2 ] Bien que dûment convoqué et appelé en salle de Cour, l’appelant était absent le jour de l’instruction de cette requête.
L’audition de celle-ci a donc eu lieu en son absence. 1) Demande de sanction quant à des abus de la procédure [ 3 ] Les intimés allèguent dans leur requête ce qui suit : 1. The present Motion To Dismiss A Motion For Opposition To a Writ Of Eviction, To Sanction An Abuse Of Procedure, And To Declare Simon Bensoussan A Quarrelsome Litigant seeks to dismiss Appellant's Motion for Opposition to a Writ of Eviction , on the basis that said Motion constitutes an abuse that should be sanctioned by this Honorable Court, for the reasons explained hereinbelow; 2.
Administrative Judge Andre Gagné rendered Judgment on dated May 12 th , 2015 (hereinafter " the Regie Judgment "), granting Respondents repossession of the apartment at […] , in the City of Montreal, (hereinafter " the Dwelling "), and ordered provisional execution, notwithstanding appeal, the whole as more fully appears from the Regie Judgment, communicated herewith as Exhibit R-1 ; 3. Within the Regie Judgment, Administrative Judge Andre Gagné points out the abusive manner in which Appellant conducted himself throughout the 3 days of hearing, which included: a.
Making numerous motions for postponement throughout the hearing
b. Making two motions for recusation (par. 9 & 10 of Judgment) c. Repeating the same things umpteen times even though the Court informed him that this evidence was completely irrelevant (Par. 11 of Judgment) d. Producing over 30 exhibits to support his case, of which almost all were completely irrelevant e. Making sure his cross-examination was as lengthy and repetitive as possible f. Ensuring that the first day of the hearing was almost entirely devoted to his frivolous motions for postponement and recusation; 4.
Following the Regie Judgment, Appellant petitioned the Regie du Logement for a revocation of the Regie Judgment, and the Regie Judgment rendered by the Administrative Judge Serge Adam dated June 23 rd , 2015 (hereinafter " the Revocation Judgment ") dismissed Appellant's Motion in Revocation, noting that it was essentially a disguised appeal, the whole as more fully appears from the Revocation Judgment, communicated herewith as Exhibit R-2 ; 5.
The Revocation Judgment points out at paragraph 39 the " le Tribunal tient à rappeler au locataire qu'une autre demande pourrait être jugée abusive et donner ouverture a une demande en dommages de la part du locateur " 6.
Undeterred by the comments regarding his conduct in the Regie Judgment and the Revocation Judgment, Appellant sought leave to appeal both of said judgments and suspension of execution from this Honorable Court, through a Motion for Permission to Appeal the Decisions of the Rental Board and Suspension of the Execution of the Decision , which was dismissed by Judgment dated July 13 th , 2015, emanating from the Honorable Jacques Paquet, J.C.Q. (hereinafter " the Appeal Judgment "), the whole as more fully appears from the Appeal Judgment, communicated herewith as Exhibit R-3 ; 7.
Following the Appeal Judgment, Respondents had a 48 hour notice served upon Appellant on July 14 th , 2015, in conformity with the provisions of
article 565 of the Code of Civil Procedure , (hereinafter " the Notice "), with the intent of issuing a writ of expulsion on July 16 th , 2015, in conformity with the provisions of the Regie Judgment, the whole as more fully appears from copy of the Notice, communicated herewith as Exhibit R-4 ; 8. Respondents intend to execute the Regie Judgment on July 16 th , 2015, and issue a writ of expulsion for the Dwelling on the same date, as is their strict right to do so in virtue of the Regie Judgment, the Revocation Judgment and the Appeal Judgment; 9.
Not surprisingly, on July 15 th , 2015, Appellant had Appellant's Motion for Opposition to a Writ of Eviction (hereinafter " the Motion ") served upon Respondents, whereby he seeks abusively seeks to oppose the Notice , and even more abusively, chose August 14 th , 2015, as the date of presentation in an effort to use a procedural tactic to thwart his impending expulsion; 10.
Choosing August 14 th , 2015 as a date of presentation for an opposition to an eviction scheduled for July 16 th , 2015 is ludicrous on its face and Appellant is trying to do indirectly what he has been directly refused, which is the suspension of the execution of the Regie Judgment; 11. As it appears from the Motion, in substance, Appellant is indirectly attempting a disguised appeal or revocation of the Appeal Judgment, notwithstanding that this Honorable Court cannot sit in appeal or review of its own judgments; 12.
As it appears from the Court record, the Motion is essentially a copy/paste reproduction of the Motion for Permission to Appeal the Decisions of the Rental Board and Suspension of the Execution of the Decision , and it is clear and obvious that the Appellant
instituted a completely frivolous procedure in an effort to buy himself more time; 13. The Motion is doomed to fail and has no chance of success, and Appellant is playing on the fact that no bailiffs in Quebec will execute a writ of expulsion after having been served with proceedings in opposition pending before this Honorable Court, regardless if whether said proceedings are founded or not; 14.
Appellant is aware of the fact that the Respondents must be moved into the Dwelling and out of their current home by July 20 th , 2015, and is amusing himself at the expense of Respondents and attempting to use this Honorable Court to that end, and this Honorable Court must sanction Appellant's conduct in no uncertain terms; 15.
As it appears from Respondent Chaim Langsam's Affidavit in the Court record, Respondents have four (4) young children and without the execution of the Regie Judgment on July 16 th , 2015, Respondents will literally have nowhere to live with their young children; [Sic] [ 4 ] Suivant la signification de l' Appellant’s Motion for Opposition to a Writ of Eviction (Requête de l’appelant) dont il est question ci-dessus, les intimés ont sans délai produit et signifié une requête en rejet de la Requête de l’appelant présentable le 17 juillet 2015. [ 5 ] Ces deux requêtes ont, de fait, été entendues par le juge Henri Richard, J.C.Q., le 17 juillet 2015 en la présence de l’appelant. [ 6 ] Le juge Richard a rendu sa décision le jour même [2] .
Elle va comme suit : [1] CONSIDERING the allegations contained in the Lessor's Motion To Dismiss A Motion For Opposition To A Writ Of Eviction, To Sanction An Abuse Of Procedure, And To Declare Simon Bensoussan A Quarrelsome Litigant and the Exhibits filed in support of said Motion; [2] CONSIDERING that on May 12 th , 2015, the Régie du logement rendered a decision in the file 192528 31 20150108 G containing, in particular, the following conclusions: [91] ORDONNE l'expulsion du locataire (Simon Bensoussan) et de tous les occupants à compter du 16 juillet 2015 à 12 h 00; [92] ORDONNE l'exécution provisoire nonobstant appel de l'ordonnance d'expulsion; [3] CONSIDERING that by judgment rendered on July 13 th , 2015, the Court of Québec dismissed Lessee's Motion For Grant Of Appeal of said decision of the Régie du logement and Lessee's " Motion to Suspend The Execution Of Said Decision "; [4] CONSIDERING that the Court has no jurisdiction to suspend or dismiss the provisional execution of the said decision of the Régie du logement; [5] CONSIDERING that Lessee's Motion For Opposition To A Writ of Eviction constitutes a disguised appeal of the provisional execution of the expulsion rendered by the Régie du logement; [6] CONSIDERING that the Court is proceeding only on the portion of Lessor's Motion To Dismiss A Motion For Opposition To A Writ Of Eviction ;
[7] CONSIDERING that the other issue of Lessor's Motion will have to be presented at a later date; FOR THESE REASONS, THE COURT: REDUCES the delays of service, production and presentation of Lessor's Motion To Dismiss A Motion For Opposition To A Writ Of Eviction ; GRANTS Lessor's Motion To Dismiss A Motion For Opposition To A Writ Of Eviction ; DISMISSES Lessee's Motion For Opposition To A Writ Of Eviction ; DECLARES that the present Court has no jurisdiction to suspend or dismiss the provisional execution of Lessee's expulsion; PERMITS Lessors to execute the decision rendered by the Régie du logement on May 12 th , 2015 in the file 192528 31 20150108 G and confirmed by the Honorable Jacques Paquet, J.C.Q., on July 13 th , 2015 by a writ of expulsion to be executed at any time from the present judgment, and outside of legally required hours and on non-juridical days, if necessary; POSTPONES to another date, to be determined by the Lessors, the presentation of the other issues contained in their " Motion To Dismiss A Motion For Opposition To A Writ Of Eviction, To Sanction An Abuse Of Procedure, And To Declare Simon Bensoussan a Quarrelsome Litigant "; ORDERS the provisional execution of the present judgment, notwithstanding appeal; RESERVES to the Lessors all their rights against the Lessee; THE WHOLE, WITH COSTS. [ 7 ] Les intimés réclament à l’appelant, à
titre de sanction pour les abus de la procédure qu'ils allèguent, le remboursement des honoraires et débours extrajudiciaires qu’ils ont engagés. Ceux-ci s’élèvent à un montant de 4 886.44 $ [3] . [ 8 ] L’
article 54.1 C.p.c. trouve application en l’instance. Il se lit comme suit : 54.1. Les tribunaux peuvent à tout moment, sur demande et même d'office après avoir entendu les parties sur le point, déclarer qu'une demande en justice ou un autre acte de procédure est abusif et prononcer une sanction contre la
partie qui agit de manière abusive. L'abus peut résulter d'une demande en justice ou d'un acte de procédure manifestement mal fondé, frivole ou dilatoire, ou d'un comportement vexatoire ou quérulent. Il peut aussi résulter de la mauvaise foi, de l'utilisation de la procédure de manière excessive ou déraisonnable ou de manière à nuire à autrui ou encore du détournement des fins de la justice, notamment si cela a pour effet de limiter la liberté d'expression d'autrui dans le contexte de débats publics. [ 9 ] La Cour d’appel du Québec, dans l’arrêt Acadia Subaru c.
Michaud [4] , s’est prononcée sur ce qui constitue un abus au sens de l’alinéa 2 de l’article 54. 1 C.p.c. Elle s’exprime à cet égard comme suit :
[ 42 ] Among other differences, there is a measure of blame associated with a finding that an action or proceeding is improper that is not necessary under article 165(4) C.C.P. If the French word " abus " signals this more resolutely than the term "impropriety", both linguistic texts of
article 54.1 , paragraph 2 C.C.P. make the underlying idea of a wrongful use of procedure plain in the description of what constitutes improper proceedings. [5] The finding that a claim or pleading is "clearly unfounded" is presented alongside alternatives that it is "frivolous or dilatory". Other instances of impropriety in
article 54.1 speak to conduct that is "vexatious or quarrelsome", in "bad faith" or to a use of procedure that is "excessive", "unreasonable" or prejudicial to the interests of another. Likewise, an "attempt to defeat the ends of justice" carries with it a connotation of wrongful conduct on the part of a litigant that is not necessarily present in respect of preliminary exceptions brought outside the ken of
article 54.1. Abuse under
article 54.1 brings consequences that, as a general rule, would not flow from a ruling made under article 165(4). [6] Indeed the remedies available in the event of a finding that a claim is improper or appears to be improper are wider, allowing a court to tailor a sanction to answer the specific character of the wrongful behaviour in question. In principle, the preliminary exception brought under article 165(4) C.C.P., where granted, allows only for a complete dismissal of the action and an ordinary order as to costs. [ 10 ] Or, la preuve administrée par les intimés permet au Tribunal de conclure que la Requête de l’appelant constitue bel et bien une procédure abusive au sens de l’
article 54.1 C.p.c. [ 11 ] Conformément à l’
article 54.4 C.p.c. , le Tribunal donne ainsi droit à la demande des intimés en remboursement des honoraires et débours extrajudiciaires qu'ils ont dû engager pour contrer la procédure abusive de l'appelant et qui s'élèvent en l'occurrence à la somme de 4 886.44 $. [ 12 ] Les intimés demandent par ailleurs que la dette de 3 000 $ à laquelle ils sont tenus envers l'appelant aux termes du jugement rendu par la Régie du logement le 12 mai 2015 s'éteigne par compensation avec la dette à laquelle l'appelant pourrait être tenu au terme du présent jugement. Or, la compensation dans une telle situation pourra s'opérer de plein droit suivant l’
article 1673 du Code civil du Québec [7] (C.c.Q.) dès que ces dettes seront l'une et l'autre certaines, liquides et exigibles. Le Tribunal n’a ainsi pas à intervenir pour y donner suite. 2) Plaideur quérulent [ 13 ] Le juge Stephen W. Hamilton dans la cause Tiffany Towers Co-ownership Syndicate c. Schnabel [8] , fait une revue de la doctrine et de la jurisprudence quant aux facteurs à considérer afin de déclarer un justiciable plaideur quérulent.
On peut y lire ceci : [13] In addition to all of the foregoing, in an extreme case (“ dans les cas les plus extrêmes ” [9] ), the court has the further power to prohibit a person that it finds to be “quarrelsome” from instituting legal proceedings except with prior judicial authorization, and even to prevent the person from having access to the courthouse. [10] [14] The doctrine and the jurisprudence have set out a number of factors common to quarrelsome litigators which assist in determining whether a particular person is quarrelsome. [15] In Papillon c. Lemay , Mr.
Justice Alain identified the following eleven factors: [36] On retient généralement que la personne qui fait preuve d'un comportement quérulent: 1) fait montre d'opiniâtreté et de narcissisme; 2) se manifeste en demande plutôt qu'en défense; 3) multiplie les recours vexatoires; 4) réitère les mêmes questions par des recours successifs et ampliatifs et recherche les mêmes résultats malgré les échecs répétés des demandes antérieures; 5) met de l'avant des arguments de droit qui se signalent à la fois par leur inventivité et leur incongruité; 6) devient incapable à plus ou moins longue échéance de payer les dépens et les frais de justice auxquels il est condamné et cela à cause des échecs répétés de ses recours; 7) porte en appel toutes les décisions qui la désavantagent et fait des demandes répétées de révision, de rétractation ou de nullité de jugement ou d'entente signée par elle; 8) se représente souvent seule;
9) rédige des procédures longues, incompréhensibles, souvent truffées d'accusations, d'insultes et d'injures à l'égard des parties adverses; 10) annonce la venue de témoins qui viendront contredire les parjures et les faux témoignages qui ont été faits lors d'instances précédentes; témoins qui ne se présentent souvent pas ou qui viennent simplement faire des affirmations générales qui n'ont aucune pertinence avec litige; 11) fait très souvent preuve d'intransigeance, d'impertinence et d'insolence. [11] [16] In Pogan c. Barreau du Québec, Mr.
Justice Gascon set out two further factors: [83] Pour sa part, le Tribunal ajouterait à cette énumération deux autres traits assez courants en la matière :
a) La recherche de condamnations monétaires démesurées par rapport au préjudice réel allégué et l'ajout de conclusions atypiques n'ayant aucune commune mesure avec l'enjeu véritable du débat;
b) L'incapacité et le refus de respecter l'autorité des tribunaux dont le plaideur quérulent revendique pourtant l'utilisation et l'accessibilité. [12] [17] As Mr. Justice Gascon pointed out, it is not necessary for every factor to be present. [13] [ 14 ] Le Tribunal est ici d'avis que la preuve telle qu’administrée par les intimés ne permet pas d'établir que nous sommes, à ce moment, dans l'un de ces cas "extrêmes" [14] d'abus de la procédure permettant de conclure que l’appelant est un plaideur quérulent. PAR CES MOTIFS, LE TRIBUNAL : ACCUEILLE en
partie la requête des intimés. DÉCLARE que l’Appellant’s Motion for Opposition to a Writ of Eviction est abusive conformément à l’
article 54.1 du Code de procédure civile . CONDAMNE l’appelant, Simon Bensoussan, à payer aux intimés, Chaim Langsam et Henyan Kaplan, la somme de 4 886.44 $ avec les intérêts au taux de 5 % l'an plus l'indemnité additionnelle prévue à l'
article 1619 du Code civil du Québec , à compter de ce jour. REJETTE la demande des intimés afin que l’appelant soit déclaré plaideur quérulent.
