P-34.1 ) ______________________________________________________________________ WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified. Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Director of Youth Protection A asks the Court to review the decision rendered on March 24, 2017 by Honourable Judge Louis Grégoire concerning X, born on [...], 2001.
He asks for the youth’s placement in a foster home until her majority. [ 2 ] At the hearing, the mother and the youth are present, assisted by Me Marie-Josée Ayoub and Me Michel Grenier. Me Camille Champeval represents the applicant, Mr [Social Worker 1]. The father was served, but he is absent. [ 3 ] The mother and the youth admit most of the allegations and agree with the measures. A revision report is filed and the applicant testifies. [ 4 ] Following the last judgment, the youth remained placed at the group home of City A, where she had done very well.
The youth is now able to respect the rules, does all her chores and is respectful towards the workers. She attends school regularly and she has no behavioural problems. [ 5 ] Because of such improvement, integration at Mrs C’s home started last November 1. She continues to be respectful of the rules, of the chores and of the people there. She has regular contacts with her mother. [ 6 ] As the mother has not been engaging fully with the social worker and as she did not quit alcohol consumption, she cannot assume her daughter on full-time basis. She acknowledges that her cousin Veronica is more suitable to do so.
She can provide the security, the stability and the guidance that X needs. [ 7 ] The recent follow-up of X with the psychologist last November helps her a lot to accept her situation.
The mother also had the chance to meet with the same psychologist and she considers it might help both of them to facilitate the communication and to deal with their emotions. [ 8 ] Considering the revision report and the observation report filed and that they have the same recommendations; [ 9 ] Considering the parties’ agreement with the recommendations; FOR THESE MOTIVES, THE COURT: [ 10 ] GRANTS the motion; [ 11 ] DECLARES that the security and development of X are still in danger;
[ 12 ] ORDERS the placement of X in the foster home of Mrs C until her majority; [ 13 ] ORDERS the Director of Youth Protection to provide all the medical and psychological services the youth needs; [ 14 ] ORDERS the youth to collaborate with the social worker and psychologist; [ 15 ] ORDERS the Director of Youth Protection to provide aid, counselling and assistance to the youth and her parents until the youth’s majority (if the father collaborates and wishes to have contacts with his daughter); [ 16 ] ORDERS the Director of Youth Protection to supervise the contacts between the youth and her parents; [ 17 ] ORDERS any police officer to collaborate in the execution of the present judgment; [ 18 ] ENTRUSTS the youth's situation to the Director of Youth Protection for the purpose of executing this judgment. __________________________________ DENYSE LEDUC, J.C.Q.
