Article 95 L.P.J. ______________________________________________________________________ MISE EN GARDE : La
Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d'identifier un enfant ou ses parents.
Quiconque contrevient à cette disposition est passible d'une amende. [articles 11.2.1 et 135 L.P.J .] [ 1 ] Le présent jugement constitue la version écrite et motivée confirmant le jugement rendu oralement lors de l'audience tenue le 1 er septembre 2016. [ 2 ] Le 18 avril 2016, saisi d'une requête en révision d'ordonnance, le Tribunal concluait que la requête était bien fondée en faits et en droit pour les motifs allégués qui se lisaient ainsi : [ 3 ] The adolescent remains in the mother's care; [ 4 ] On December 2015, the adolescent presented herself at the Hôpital Rivière-des-Prairies for suicidal ideations; [ 5 ] Since, the adolescent has been receiving therapy twice a week; [ 6 ] The adolescent is emotionally unstable and is presently taking medication to address depressive and anxious symptoms; [ 7 ] The mother and the adolescent have a conflictual relationship; [ 8 ] The adolescent's behaviours have been deteriorating, more particularly but not restrictively in that :
a) the adolescent associates with negative peers, adult men, drug users and an individual who previously attempted to rape her;
b) the adolescent consumes marijuana and alcohol;
c) the adolescent is not forthcoming about her whereabouts;
d) the adolescent's school attendance is decreasing;
e) the adolescent's academics is suffering;
f) on one (1) occasion, the adolescent stole from a commercial store;
g) on March 27, 2016, the adolescent was dishonest about her whereabouts, did not respect her curfew, purchased marijuana and returned home under the influence of drugs and alcohol;
[ 9 ] The adolescent makes poor decisions; [ 10 ] The adolescent is currently vulnerable and susceptible to peer pressure; [ 11 ] More recently, the mother and Mr. B found a text message from the adolescent to the effect that she was going to meet a male individual after school to purchase LSD; [ 12 ] The mother expresses that she will keep the adolescent home as she fears the latter will make a drug transaction; [ 13 ] The mother is imminently going to enter a in-patient drug treatment program to address her consumption issues; [ 14 ] Mr.
B verbalizes not being in a position to ensure the supervision that the adolescent presently requires; [ 15 ] The mother is in agreement that the adolescent requires, at this point in time, the structure of a rehabilitation centre; [ 16 ] À cette date, à la demande et du consentement de toutes les parties, le Tribunal rendait une ordonnance intérimaire pour une période de trios (3) mois; il ordonnait alors l'hébergement de l'adolescente en centre de réadaptation pour une période maximale de trois (3) mois, de même que certaines autres mesures visant à protéger l'adolescente. [ 17 ] L'audition de l'enquête sur les mesures était fixée au 6 juillet 2016, date à laquelle la soussignée se voyait dans l'obligation de reporter l'audition pour encombrement du rôle. [ 18 ] L'audition est alors reportée au 1 er septembre 2016. [ 19 ] Audition sur les mesures [ 20 ] [Intervenant 1], intervenant social, dans un rapport [1] daté du 29 août 2016, précise l'évolution depuis la dernière date d'audience et conclut ainsi : « The family problems remain; pertaining to Ms.
A's drug addiction, X's emotional problems of depression and anxiety, intense conflict between X and her mother, X being made aware of the parental issues, school avoidance, use of marijuana and curfew issues. The worker recommends that more time is required for X and the family to continue working on stability. The worker maintains the same recommendation as in the previous addendum report, dated June 28, 2016. Mr. B has expressed agreement with this plan. Ms.
A has not returned telephone calls to the worker. » [ 21 ] Toutes les parties admettent que la situation, telle que décrite par l'intervenant social, représente bien la réalité qu'elles vivent. [ 22 ] La mère exprime son accord avec les recommandations bien qu'elle précise certains éléments. [ 23 ] L'adolescente a aussi exprimé son accord avec les recommandations bien qu'elle ait fait certaines demandes en lien avec son lieu d'hébergement et sa possibilité de participer à une activité sportive. [ 24 ] Le Tribunal tient à souligner les efforts faits par l'adolescente durant toute cette période. [ 25 ] Compte tenu de la nature des difficultés vécues par la famille, le fait que l'adolescente exprime consentir à ces mesures, le Tribunal conclut que les recommandations de la requérante sont dans l'intérêt de l'adolescente. [ 26 ] CONSEQUENTLY, THE COURT : [ 27 ] GRANTS the motion; [ 28 ] DECLARES that the security and development of the adolescent X are still endangered. [ 29 ] AND THEREFORE, ORDERS THE FOLLOWING MEASURES : [ 30 ] ORDERS that the adolescent X be entrusted to a rehabilitation centre until June 30, 2017; [ 31 ] ORDERS that frequency and modalities of contact between the adolescent, her mother and Mr.
B be determined by DYP; [ 32 ] ORDERS that the adolescent undergo random drug testing, taking judicial notice of her agreement to do so; [ 33 ] STRONGLY RECOMMENDS that mother continue with her treatment for drug addiction and follow the recommendations being made; [ 34 ] ORDERS that mother and Mr.
B not expose X to their adult issues; [ 35 ] ORDERS that the adolescent receive all the necessary medical follow-up she requires, including therapy in a timely matter; [ 36 ] ORDERS that the adolescent continue her activity of kickboxing ; if there is any difficulty with any other activity in her schedule, it should be discussed among all parties; [ 37 ] ORDERS that aid, counsel and assistance be provided to the adolescent and her family; [ 38 ] THE WHOLE for a period of one (1) year as of today, being until September 1 st , 2017.
[ 39 ] ENTRUSTS the situation of the adolescent X to the Director of Youth Protection of the CIUSSS A for the execution of the present judgment.
