Any person who contravenes this provision commits an offence and is liable to a fine (sections 9.2, 9.3 and 135 Y.P.A.). [ 1 ] On September 17, 2021, the Court renders a one year protection order in regards to the youth which, within the various measures, provides for her placement in foster care until June 24, 2022. [ 2 ] The Director of Youth Protection seeks the revision and extension of this order until the youth’s majority, including that the youth be maintained in her foster family. [ 3 ] The youth consents to the application.
Although the mother is absent, the evidence suggests that she is also in agreement. [ 4 ] The Court endorses the conclusions. Herewith are the reasons justifying this decision. Analysis and decision [ 5 ] Since the last order, the youth resides in foster care. [ 6 ] She is evolving generally well.
Certain issues are ongoing in relation to her motivation and organization but overall, she is improving with regards to her autonomy, especially since a move to another foster family. [ 7 ] She is in her last year of high school. [ 8 ] Although the relationship with her mother improves, the family dynamic remains challenging and difficult for the youth to deal with. [ 9 ] The mother continues to struggle on many levels. [ 10 ] She maintains her sobriety and receives support services from the CLSC for her personal issues.
Although her collaboration with the Director tends to vary, she has recently shown more openness to services. [ 11 ] The youth asks to remain in her present foster family until the end of the school year, which is after her date of majority. Her mother is in agreement with this plan. FOR ALL THESE REASONS, THE COURT:
[ 12 ] GRANTS the application; [ 13 ] DECLARES that the security and the development of the youth are still in danger; [ 14 ] REVISES and EXTENDS the Court order rendered on September 17, 2021; [ 15 ] ENTRUSTS the youth to a foster family chosen by the Director of Youth Protection A; [ 16 ] ORDERS that the contacts between the youth and the mother be following agreement between the parties; [ 17 ] ORDERS that the youth not be left alone with Mr. B; [ 18 ] TAKES AC T that Mr.
B will have some short stays at home upon agreement between the parties; [ 19 ] ORDERS that the mother report periodically to the Director of Youth Protection on the measures she applies in her own regard or her child’s regard to put an end at the situation in which the security or development of the child is in danger; [ 20 ] ORDERS that the youth and her mother take an active
part in the application of the measures ordered; [ 21 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to the youth and his family; [ 22 ] ALL THESE MEASURES until the youth’s majority, on [...], 2022; [ 23 ] ENTRUSTS the situation of the youth to the Director of Youth Protection A for the execution of the present judgment. __________________________________ BÉATRICE CLÉMENT, J.C.Q.
