THE COURT The motion by the Town of Riverview to quash the Notice of Appeal and the Amended Notice of Appeal is allowed with costs on a solicitor and client basis.
____________________________________ J. English version of the decision of the Court delivered by DRAPEAU, C.J.N.B. (Orally) [1] The Town of Riverview applies by way of motion for an order quashing the Notice of Appeal and the Amended Notice of Appeal against decisions rendered by a judge of the Court of Queen’s Bench in the context of an application she is tasked with determining. The application is for the issuance of an order compelling the appellant to cease renovations of a building. The history of the litigation is set out in Charlebois v.
Town of Riverview and Attorney General of New Brunswick , 2015 NBCA 45 , 437 N.B.R. (2d) 111 , and need not be repeated here. The hearing on the merits of the application is scheduled for August 2016. [2] Each of the decisions targeted by the Notice of Appeal and the Amended Notice of Appeal is interlocutory. The appellant has not obtained leave to appeal those decisions pursuant to Rule 62.03 of the Rules of Court . That being so, the motion is allowed, and the Notice of Appeal, as well as the Amended Notice of Appeal, are quashed.
Moreover, and having regard to the appellant’s scandalous statements about the application judge and counsel for the Attorney General, I am satisfied it is appropriate to order he pay costs on the motion to be assessed on a solicitor and client basis. If the parties are unable to agree upon an amount, it will be determined by the Registrar.
