The following is the judgment delivered by
THE COURT [ 1 ] Following her guilty plea in Provincial Court to the offences set out below, the appellant was sentenced as follows: Offence
Section Date of Offence Sentence Imposed Conspiring to traffic drugs (Federal Crown) 465(1)(
c) CC July 4 th , 2019 – September 1 st , 2019 3 years consecutive Possession of a weapon for a dangerous purpose 86(2) CC May 19 th , 2020 1 year concurrent Possession of a weapon for a dangerous purpose 88(1) CC May 19 th , 2020 1 year concurrent Unauthorized possession of a firearm 91(1)(
a) CC May 19 th , 2020 1 year concurrent Unauthorized possession of ammunition 91(2) CC May 19 th , 2020 1 year concurrent Possession of a prohibited firearm 95(1)(
a) CC May 19 th , 2020 8 years consecutive (less remand time, 728 days). Possession of a prohibited or restricted firearm 95(1)(
a) CC May 19 th , 2020 3 years concurrent Possession of a weapon obtained by the commission of an offence 96(2)(
a) CC May 19 th , 2020 1 year consecutive Possession of a firearm while knowing the firearm’s serial number has been tampered with 108(1)(
b) CC May 19 th , 2020 1 year consecutive Possession of property obtained by crime 355(a)(
i) CC May 19 th , 2020 1 year concurrent Trafficking in a prohibited substance (cocaine) 5(2) CDSA May 19 th , 2020 7 years concurrent Trafficking in a prohibited substance (methamphetamine) 5(2) CDSA May 19 th , 2020 7 years concurrent Total Sentence: 13 years (less remand time) [2] In imposing the various sentences, the judge gave effect to a joint recommendation. [3] The appellant seeks leave to appeal sentence, arguing it is unfair and that she agreed to the joint recommendation on the basis of incompetent advice by her counsel, including, she claims, his failure to explain her “legal options”.
She also seeks an order appointing counsel to act on her behalf in the appeal pursuant to s. 684 of the Criminal Code . [4] After hearing the appellant, we dismissed the motion. In our view, the appellant failed to make the case for the exercise of discretion contemplated by s. 684 . The pertinent considerations are set out in R. v. Smith , 2012 NBCA 99 , 396 N.B.R. (2d) 367 :
The Court's power under s. 684 is contingent upon it appearing desirable in the interests of justice that an appellant, whose indigence has been established, should have legal assistance. As a general rule, that will be so only in instances where the appeal's complexity, whether factual or legal, causes the Court or one of its judges to conclude: (1) it is unlikely the appellant will be able to make the case for intervention; and (2) the assistance of counsel is required for the panel to properly exercise its reviewing function.
It should go without saying, but there is merit in underscoring the obvious: taxpayers foot the bill for any assignment of counsel under s. 684 .
That consideration coupled with the nature of the proceedings, the fairness obligations of Crown counsel and the panel members' impartiality, knowledge of the law and experience goes a long way in explaining and justifying the exceptionality of s. 684 orders. [Emphasis in original; para. 7.] The appellant has failed to demonstrate her appeal against sentence raises questions of such complexity that the appointment of counsel under s. 684 is appropriate. [5] As to the merits of the appeal, there is no evidence to substantiate the appellant’s allegation that counsel at trial provided her with incompetent advice with respect to the legal options available to her and in connection with the joint recommendation.
Moreover, we conclude the joint recommendation was reasonable.
In that regard, suffice it to spotlight the following: (1) the appellant is a mature offender with a fairly extensive record of convictions for possession of drugs under the Controlled Drugs and Substances Act , S.C. 1996, c. 19 ; (2) she was in possession of a large quantity of cocaine and methamphetamine, and numerous firearms, including handguns; (3) she played a central role in the large-scale cocaine and methamphetamine trafficking operation at issue in the proceedings; and (4) the firearms were a key component of the drug trafficking operation. [6] We are satisfied the sentencing judge did not commit reversible error in giving effect to the joint recommendation.
Accordingly, there is no merit to the appeal against sentence and the application for leave to appeal is dismissed.
