[INTERVENANTE 1] Requérante et A B parents et La commission des droits de la personne et des droits de la jeunesse. Mise-en-cause J U G E M E N T (article 38) [ 1 ] Conformément à l'article 38 de la
Loi sur la protection de la jeunesse, le Tribunal est saisi d'une demande visant à faire déclarer que la sécurité et le développement de sont compromis pour les motifs apparaissant au paragraphe de la requête. [ 2 ] De consentement et pour valoir preuve, la Directrice de la protection de la jeunesse a versé au dossier différentes pièces (D-2 et D-3), tel qu'il appert au procès-verbal de l'audience. [ 3 ] Le père, admet l'ensemble des allégations contenues à la requête et se dit en accord avec les mesures recherchées par la Directrice. [ 4 ] La mère, par son avocate, fait des admissions au soutien de la requête au paragraphe 4: a)b)c)admis; d)nié; e)nié jusqu'à skateboard et admis pour le reste; f)g)h)admis; i)ignoré; j)k)l)admis.
Elle est en accord avec les mesures recherchées par la Directrice. [ 5 ] L'enfant, par son avocat, fait des admissions au soutien de la requête au paragraphe 4: a)nié tel que rédigé; b)c)d)e)f)g)admis; h)ignoré; i)j)k)admis; l)ignoré.
L'enfant est en accord avec les mesures recherchées par la Directrice. [ 6 ] The Director of Youth Protection alleges that the security and development of the child X are in danger for the following reasons: ➢ ON March 31, 2010, the chld told her mother that she smoked cigarettes the day before at school and an argument ensued; ➢ Sharpener blade, in order to deal with her issues; ➢ The child tied to make a deal with her mother by asking her to either allow her to smoke or to cut herself, deal that the mother
obviously refused; ➢ The mother informed the child that she would be disciplined for smoking by not being allowed to use her skateboard; ➢ As a result of not being allowed to use her skateboard, the child hit her mother on the head with the skateboard causing her mother to be admitted to the hospital; ➢ At the hospital, the mother was diagnosed with a mild concussion; ➢ The child stated that her mother was going to hit her with a belt; ➢ The mother stated that she took a belt in self-defence; ➢ The child said she is not afraid of the mother and would and would hit again if required; ➢ The child stated that the mother hits her younger brother with a belt; ➢ The child has a lot of anger towards the mother; ➢ The father uses drugs. [ 7 ] The child and her parents admitted the facts as their reality at the end of march 2010. [ 8 ] The child was entrusted to a group home and is now ready to go back with her mother. [ 9 ] X was very quiet at the group and did not present major difficulties. [ 10 ] Many services are available for X and her mother in their community.
Mother and child are ready to benefit from those services. [ 11 ] X's father wants to be involve run in his daughter's life and is making steps to solve his personal issue mainly his drug and alcohol abuse. [ 12 ] Mother is still going through a difficult moment concerning her elder daughter Y. [ 13 ] Mrs Y should concentrate her efforts on the rest of her family and make sure she offers right support and guidance to her remaining family including X. [ 14 ] THEREFORE, THE COURT: [ 15 ] DECLARE that security and development of the child in danger; [ 16 ] ENTRUST X to her mother's car for period of six months; [ 17 ] ORDERS that X and her mother participate in KSCS psychological services family therapy sessions and follows recommendations: Note that X's siblings will be part of the family therapy; [ 18 ] ORDERS the father to remain sober, and actively participates with his addictions worker and follows recommendations, including random drug screening; [ 19 ] ORDERS that contact and visitation between the father and X to be organized and supervised by the DYP; TAKE ACT that the father's situation should be re-evaluated after the first three months of the court order to decide if supervised visits need to continue; [ 20 ] ORDERS that contact and visitation between Y and X including their sibling to be organised and supervised by the DYP; [ 21 ] ORDERS that X and her parents meet with their caseworker on a regular basis to update their situation; [ 22 ] ORDERS that a person working for an instution or body provide aid, counsel or assistance to the child and the child's family for a period of six months; [ 23 ] ENTRUST the situation of the child to the Director of Youth Protection of le Centre A for the execution of the measures; __________________________________ JEAN GRAVEL, juge Cour du Québec Chambre de la jeunesse
