P-34.1 L.r.Q. ) ______________________________________________________________________ [ 1 ] Madame [intervenante 1], déléguée dûment autorisée du directeur de la protection de la jeunesse A, saisit le Tribunal d'une requête en révision et prolongation de l'ordonnance rendue le 10 juillet 2012 par l'honorable juge Daniel Bédard à l'égard de l'enfant X, âgée de 1 ½ ans. La requérante demande que l'enfant soit confiée à son père en autant que ce dernier poursuive divers suivis. [ 2 ] À l'audition, le père est présent, assisté de Me Claude Cossette.
La mère est présente, assistée de Me Claude Beaudet et l'enfant est représentée par Me Sylvie Roy. Me Valérie Martel agit pour la requérante. [ 3 ] Plusieurs allégations sont admises tant par la mère que le père et les parties se déclarent en accord avec les mesures recherchées. [ 4 ] Il est ainsi démontré que suite à la dernière ordonnance, la mère a complété une thérapie au centre A en janvier 2013 et que le père a mis fin à sa thérapie une semaine avant la fin en raison des difficultés de grossesse de la mère. En mars 2013, les parents ont requis un placement-répit de l'enfant pour une période de quatre jours.
Quelques jours après le retour de l'enfant, les parents ont connu une rechute au niveau de la consommation de drogues et d'alcool. [ 5 ] Au cours de cette période, les parents ont connu d'importants problèmes de violence tant physique que verbale. La mère s'est réfugiée à la maison d'hébergement A le 12 mai et y restée jusqu'au 19 mai. Elle a quitté [la maison d’hébergement A] le 19 mai y laissant ses enfants, alors qu'elle était informée qu'il lui était impossible de le faire. Par la suite, un hébergement provisoire a été demandé.
L'enfant est hébergée depuis, en famille d'accueil. [ 6 ] Le 19 mai, la mère a eu une altercation avec une autre femme, et le 21 mai, elle a été vue avec de multiples égratignures dans la figure. [ 7 ] Le 10 mai, le père a consommé et il s'est réfugié à A pour un certain temps. [ 8 ] Depuis, le père démontre une grande motivation à changer son mode de vie dans l'intérêt de sa fille X et de l'autre enfant née au cours de l'année.
Il offre une bonne collaboration avec les intervenants sociaux et fait régulièrement rapport sur sa situation. [ 9 ] L'enfant X a un bon lien avec son père et ce dernier est en mesure de répondre aux besoins de sa fille. Le père est conscient de l'importance de ses difficultés conjugales et déclare être en mesure de s'engager envers ses enfants. Le père constate que la mère n'accorde pas priorité aux besoins des enfants et il entend seul, offrir un milieu stable et sécurisant à ses enfants.
Le père veut se reprendre en main de façon sérieuse et permanente. [ 10 ] Le père est impliqué dans un suivi avec madame [intervenante 2], intervenante en santé mentale dans sa communauté. Depuis
février dernier, il s'active à rester sobre et à maintenir ses suivis. Il a amorcé une thérapie pour sa dépendance affective. Il participe également à un programme pour son problème de violence et maintient un suivi avec le psychologue. L'intervenante, madame [intervenante 2], confirme que le père est bien motivé à s'occuper des enfants et qu'il a les capacités de le faire. [ 11 ] Quant à la mère, elle vit présentement avec sa belle-mère et vient d'amorcer des démarches pour bénéficier d'une thérapie en toxicomanie.
Elle reconnaît les capacités du père à s'occuper de l'enfant et accepte de ne pas intervenir dans le milieu du père. Elle reconnaît qu'elle doit faire ses démarches avant de s'impliquer plus activement auprès de X. Elle accepte la supervision de ses contacts auprès de l'enfant. [ 12 ] L'intervenante sociale croit dans les capacités de monsieur B à s'impliquer auprès de ses enfants et à répondre à leurs besoins. Il a déjà bénéficié d'un programme de six mois en thérapie fermée, démontrant le sérieux de ses démarches. Son intérêt envers ses enfants est réel.
Il connaît les ressources disponibles dans sa communauté et entend requérir leur aide pour pouvoir assumer ses enfants. [ 13 ] Considérant l'intérêt de l'enfant X, compte tenu de sa vulnérabilité et de l'instabilité qu'elle a connue jusqu'à ce jour, il importe de favoriser son investissement auprès de son père.
Elle doit accroître son sentiment d'appartenance et construire un lien d'attachement sécurisant auprès de son père. [ 14 ] Dans un tel contexte, après analyse de la preuve et lecture du rapport de révision et des recommandations et avec la prise en compte de l'accord des parties, le Tribunal entérine les recommandations de l'intervenante sociale. [ 15 ] POUR CES MOTIFS, LE TRIBUNAL : [ 16 ] ACCUEILLE la requête; [ 17 ] DÉCLARE que la sécurité et le développement de l'enfant X sont toujours compromis; [ 18 ] CONFIE l'enfant X à son père, monsieur B, pour une période de six mois; [ 19 ] ORDONNE que le père bénéficie d'un suivi post-thérapie quant à son problème de toxicomanie et qu'il poursuive son suivi pour personne violente aussi longtemps que les professionnels les jugeront requis; [ 20 ] ORDONNE au père de poursuivre son suivi auprès du psychologue pour la durée que le professionnel le jugera requis; [ 21 ] ORDONNE que les contacts entre l'enfant et sa mère soient supervisés par le directeur de la protection de la jeunesse; [ 22 ] ORDONNE à la mère de bénéficier d'une thérapie en toxicomanie ainsi qu'une thérapie psychothérapeutique individuelle pour la durée que les professionnels les jugeront requis; [ 23 ] ORDONNE qu'une personne qui travaille pour le Centre de protection de l'enfance et de la jeunesse apporte aide, conseil et assistance à l'enfant et à ses parents pour une période de 18 mois; [ 24 ] CONFIE la situation de l'enfant au directeur de la protection de la jeunesse pour l'exécution de l'ordonnance. __________________________________ DENYSE LEDUC, J.C.Q.

chapter P-34.1) ______________________________________________________________________ [1] [Social Worker 1], representative duly authorized by the Director of Youth Protection A, seized the Court of a motion for review and extension of the order rendered on July 10, 2012 by the Honourable Daniel Bédard J. with regard to the child X, who is one- and-a-half years old. The petitioner requests that the child be entrusted to her father, provided he continues with various follow-ups. [2] The father was present at the hearing and assisted by Mtre. Claude Cossette. The mother was present and assisted by Mtre.
Claude Beaudet, and the child was represented by Mtre. Sylvie Roy. Mtre. Valérie Martel acted for the petitioner. [3] Several allegations were admitted by both the mother and the father, and the parties said they agreed with the measures sought. [4] Thus, it has been shown that, following the last order, the mother completed therapy at A in January 2013 and the father ended his therapy one week before completion because of the mother’s problems with her pregnancy. In March 2013, the parents requested a respite placement of the child for a period of four days.
A few days after the child’s return, the parents relapsed into drug and alcohol use. [5] During that period, the parents had major problems with both physical and verbal violence. The mother took refuge at the A on May 12, 2013 and stayed there until May 19. She left A on May 19, leaving her children there even though she had been told she could not do so. Subsequently, a provisional placement was requested.
The child was placed with a foster family, where she has been living ever since. [6] On May 19, the mother had an altercation with another woman, and on May 21, she was seen with numerous scratches on her face. [7] On May 10, the father used substances and took refuge at A for a time. [8] Since then, the father has been strongly motivated to change his way of life in the interest of his daughter X and the other child, who was born during the year.
He cooperates well with the social workers and regularly reports on his situation. [9] The child X has a good bond with her father, who is able to meet his daughter’s needs. The father is aware of the extent of his conjugal problems and says he is able to make a commitment to his children. The father sees that the mother does not give priority to her children’s needs, and he intends to provide his children with a stable and secure environment on his own.
The father wants to seriously and permanently take himself in hand. [10] The father has been involved in follow-up with [Social Worker 2], a mental health worker in his community. Since February 2013, he has put his energy into remaining sober and continuing with follow-up. He started therapy for his emotional dependency. He also takes
part in a program for his violence problem and is continuing follow-up with the psychologist. [Social Worker 2], the caseworker, confirmed that the father is highly motivated to take care of the children and that he has the ability to do so. [11] As for the mother, she is currently living with her stepmother and has begun taking steps to undergo substance abuse therapy. She acknowledged the father’s ability to take care of the child and agreed not to intervene in the father’s environment. She acknowledged that she must take steps before being more actively involved with X.
She agrees to have supervised contact with the child. [12] The social worker believes that Mr. B is able to be there for his children and meet their needs. He has undergone a six-month therapy program as an in-patient, which shows the seriousness of his efforts. His interest in his children is genuine.
He is aware of the resources that are available in his community and intends to request their help in order to assume responsibility for his children. [13] Considering the interest of the child X, and given her vulnerability and the instability she has experienced to date, it is important to encourage her involvement with her father.
She must increase her sense of belonging and build a reassuring attachment relationship with her father. [14] In the circumstances, after analyzing the evidence and reading the review report and recommendations, and taking into account the parties’ agreement, the Court confirms the social worker’s recommendations. [15] THEREFORE, THE COURT:
[16] ALLOWS the motion; [17] DECLARES that the security and development of the child X are still in danger; [18] ENTRUSTS the X to her father, B, for a period of six months; [19] ORDERS that the father undergo post-therapy follow-up for his substance abuse problem and that he continue his follow-up for violent persons for as long as deemed necessary by the professionals; [20] ORDERS the father to continue his follow-up with the psychologist for as long as deemed necessary by the professional; [21] ORDERS that contact between the child and her mother be supervised by the Director of Youth Protection; [22] ORDERS that the mother undergo substance abuse therapy and individual psychotherapy for as long as deemed necessary by the professionals; [23] ORDERS that a person working for the child and youth protection centre provide aid, counselling and assistance to the child and her parents for a period of 18 months; [24] ENTRUSTS the situation of the child to the Director of Youth Protection for the execution of the order. __________________________________ DENYSE LEDUC J.C.Q.
