Counsel at hearing: For the Appellant: Jon MacQueen, on his own behalf For the Respondent: Frederick A. Welsford Nargis Kheraj, on her own behalf Avocats à l’audience : Jon MacQueen, en son propre nom Pour l’intimée : Frederick A. Welsford Nargis Kheraj, en son propre nom THE COURT I. Introduction [1] This is a motion by Nargis Kheraj for leave to intervene as an added party to the appeal under Rule 15 of theRules of Court. The appellant consents to the motion. The respondent opposes it. II. Background [2] The granting of leave to be added as a party is discretionary. In Allsco Building Products Ltd. v.
United Foodand Commercial Workers International Union, Local 1288P (1998), (NB CA), 207 N.B.R. (2d) 346, [1998] N.B.J.No. 527 (C.A.) (QL), this Court says: The granting of leave to be added as a party is purely discretionary. The litigants must not be impeded in their lawsuit and the applicantmust have something important to add to the issue before the court, for example a special expertise not otherwise available to the court. In addition, the application must be made in a timely manner, a consideration in this case.
The applicant will be in a strong position if theapplicant has a genuine and significant interest in the subject matter or will be adversely affected by the judgment; a seriouspreoccupation with the subject matter is insufficient. Local 1288P contends that the principal New Brunswick case which sets out the test as to whether an applicant meets the standard setforth under Rule 15.02 is Morgentaler v.
New Brunswick (Attorney General) et al. (1994), (NB KB), 150 N.B.R.(2d) 195; 385 A.P.R. 195 (Q.B.).[as per N.B.R.] There Stevenson, J., held that the interest in the subject matter of a proceeding meant adirect interest. Absent a direct interest, he said that the intended evidence or argument must be such as to assist the court and wouldotherwise be unavailable.
At p. 204, para. [12] he said: “A party who seeks leave to intervene because it claims an interest in the subject matter of the proceeding must persuade the court that ithas either a direct interest in the subject matter or, absent such a direct interest, that its intervention will result in evidence or argumentbeing presented that will assist the court in resolving the issues in the proceeding, and that such evidence or argument will not beavailable to the court if the intervention is not permitted.”
Nowhere in Rule 15.02 is there an indication that the interest in the subject matter of the proceeding must be a direct interest. […] [paras.4-6] [Emphasis added.] II. Analysis [3] In applying Allsco to the case before us, it is our view that although Mrs. Kheraj does not have information ormaterials to add to the issue before the Court, she does have a “genuine and serious interest in the subject matter” of this appeal andcould be “adversely affected” by the result. [4] With respect to the timeliness aspect of the test, Mrs.
Kheraj has advised she does not wish to file anyadditional written submissions or other material. She advised the Court she would rely solely on her affidavit for this motion, the materialfiled by the appellant to date as well as the materials the appellant intends to file as part of his motion to admit fresh evidence. III. Disposition [5] Therefore, we grant the motion without costs on the condition that Mrs. Kheraj cannot file a submission onappeal and she will rely on the submission, documents and evidence filed or allowed to be filed by the appellant.
As the appeal has beenperfected, it will be set down to be heard on a date to be determined by the Chief Justice. [6] The style of cause shall be amended accordingly and identify Mrs. Kheraj as an intervenor.
L’intimée l’a contestée. II.
United Food and Commercial Workers International Union, Local 1288P (1998), (NB CA), 207 R.N.-B. (2e) 346, [1998] A.N.-B. no 527 (C.A.)
