P-34.1 R.S.Q. ) ______________________________________________________________________ [ 1 ] Mrs [Social Worker 1], delegate of the Director of Youth Protection A, asks the Court to review the last Court decision rendered on August 18, 2009. Then, the youth was placed in a foster family until her majority, and today, the social worker asks for the withdrawal from the father of some parental authority attributes. [ 2 ] At the hearing, the youth is present and represented by Me Angela Tommasel. The father is aware of the revision. The mother is deceased.
Me Valérie Martel represents the petitioner. [ 3 ] Such petition is required because the mother, sole parent involved in the youth's life, passed away on May 10, 2012. Since 2007, the father refused to get involved with the social worker. During the last phone conversation on June 22, 2012, the social worker tried to explain that he is the only legal tutor of the youth, and consequently, she would need his collaboration for the youth's benefit, but he refused. He does not want to do anything with the social worker. [ 4 ] His involvement with the youth is some phone calls and messages on Internet.
She did not see him for more than a year. [ 5 ] As the youth evolves in the same foster family for five years and needs many authorizations to attend all her activities, the social worker asks for the withdrawal of some authority from the father on the youth and entrusts them to Mrs B, the foster mother. [ 6 ] Considering the evidence, [ 7 ] THE COURT : [ 8 ] GRANTS the petition; [ 9 ] DECLARES that the security and development of X are still in danger; [ 10 ] MAINTAINS all the conclusions included in the judgment rendered on August 18, 2009; [ 11 ] WITHDRAWS from the father some parental authority attributes; [ 12 ] AUTHORIZES Mrs B to give the authorizations for the youth to receive health and medical services, for the school, social and sports activities, to travel in and out of the country, to receive her driver's licence, passport or other governmental documents; [ 13 ] ENTRUSTS the youth's situation to the Director of Youth Protection for the purpose of executing this enactment.
