Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). ______________________________________________________________________ [ 1 ] La présente est la confirmation écrite de la décision rendue oralement le 25 juin 2014. [ 2 ] La Cour est saisie conformément à l'article 38 de la
Loi sur la protection de la jeunesse d'une demande visant à faire déclarer que la sécurité et/ou le développement de l'enfant X sont compromis pour les motifs apparaissant particulièrement au troisième paragraphe de la déclaration. [ 3 ] Essentiellement, la Directrice de la protection de la jeunesse allègue : "3.
The security or the development of the child is considered to be in danger for the following reasons: 3.1 as relevant background information, the mother is of [origin A] heritage and moved from City A to City B in December 2013; 3.2 in addition, the mother has resided in a shelter since her arrival in City B and currently has no residence of her own; 3.3 on March 23, 2014, the child's situation was signalled to the Director of Youth Protection as the mother indicated she was overwhelmed and wanted to sign a general consent for adoption; 3.4 on that same day, the child was entrusted to a foster home under an S4.2 Agreement; 3.5 to this day, the mother expresses ambivalence about whether or not she wishes for the child to be adopted;
3.6 on March 24, 2014, the youth protection worker assigned to the file saw the child in her foster home and observed that X had a large bump on her head and presented as lethargic; 3.7 on that same day, the child was brought to the emergency room of the [Hospital A] for a full medical examination; 3.8 a skull x-ray and blood word were done at the [Hospital A]; 3.9 said x-ray revealed that the child has a skull fracture; other medical exams were normal and the child was discharged that same day with a follow-up appointment in a few weeks in neurology; 3.10 on March 24, 2014, information from a social worker at the mother's shelter was revealed and the mother admitted that during the weekend of March 22 and 23, 2014, the mother had fallen asleep lying on her back when the child was on her chest; 3.11 the mother explains that she has moved during her sleep and found X crying face down on the floor; 3.12 upon being confronted for not having reveal his incident to the youth protection worker, the mother said that she was too scared to say anything about the fall; 3.13 the mother stated that the child fell about two and half feet on the floor; 3.14 the medical professionals at the [Hospital A] accepted the mother's explanation as credible in that the injury sustained can be the result of an accidental fall; 3.15 on March 27, 2014, the child was seen by Dr.
Munz at the [clinic A due to ongoing concerns of lethargy, irritability and unilateral leg jerking as well as hypotonic trunk and limbs and asymmetrical facial movements; 3.16 the child was seen again at the [Hospital A] on that same day; 3.17 the child remained at the [Hospital A] until April 2, 2014 and results confirmed the skull fracture as well as a small epidural hematoma; a skeletal survey did not reveal any other fractures and blood tests were normal; 3.18 the provisional agreement signed with the mother will expire on April 26, 2014 and the mother remains ambivalent about her initial plan to have the child adopted; 3.19 the mother has acknowledged using some alcohol and smoking marijuana, at times, during her pregnancy; 3.20 the mother also receives services from [Organism A]; 3.21 the mother refuses to identify the birth father other than to say that he is from City C; 3.22 it is clear that the mother is not in a position to resume caring for X at this point in time." [ 4 ] À
titre de mesure principale, la Directrice de la protection de la jeunesse recommande de confier l'enfant X à une famille d'accueil pour une période d'une année, en plus d’autres mesures visant à corriger la situation de compromission, tel qu'il appert au procès-verbal de l'audition. [ 5 ] La mère, par la voix de son procureur, se dit en accord avec les mesures recherchées par la Directrice. [ 6 ] Le procureur mandaté pour représenter l'enfant consent aux recommandations de la Directrice. [ 7 ] De consentement et pour valoir preuve, la Directrice de la protection de la jeunesse a versé au dossier les pièces suivantes: - D-1 : Child's birth certificate; - D-2: Court report prepared by [Social Worker 1], dated June 17, 2014. [ 8 ] En plus de cette preuve documentaire, le Tribunal a entendu le témoignage de madame [intervenante 1], personne autorisée par la Directrice de la protection de la jeunesse.
ANALYSE DE LA PREUVE ET DÉCISION [ 9 ] La mère de l'enfant X est une jeune femme de dix-huit ans qui est arrivée à Ville B au mois d'octobre 2013 et a donné naissance à son enfant le [...] suivant. Elle vivait [à l’organisme B] depuis le mois de décembre dernier et un incident s'est produit le 23 mars alors que le bébé est tombé en bas du lit de la mère et s'est infligé une fracture du crâne. La mère s'était endormie avec l'enfant sur son ventre. [ 10 ] Dès avant sa naissance la mère avait songé à l'adoption de son enfant.
Elle s'interroge toujours sur cette possibilité présentement et consent aujourd'hui à ce que l'enfant soit confié à une famille d'accueil pour la prochaine année. [ 11 ] L'enfant se porte bien maintenant et est décrite comme étant un bébé heureux qui découvre son environnement et les gens autour d'elle. La mère visite son enfant et les contacts se déroulent bien.
Une famille d'accueil a été identifiée à Ville C pour recevoir l'enfant à long terme si nécessaire. [ 12 ] La mère a quitté [ l’organisme B] et on ignore présentement son adresse résidentielle. [ 13 ] Il ne fait aucun doute dans l'esprit du Tribunal que la mère est incapable pour le moment d'assumer la garde de son enfant. Le
Tribunal l'invite cependant à collaborer avec l'intervenante sociale au dossier et à visiter régulièrement sa fille si elle entend éventuellement en reprendre la garde. Elle devra cependant manifester beaucoup plus de stabilité et de collaboration avec l'intervenante sociale. Les prochains mois seront importants pour son enfant et il est important que la mère fasse une réflexion en profondeur sur ses intentions et sa capacité à assumer la garde de son enfant.
Elle a donc intérêt à aller chercher l'aide nécessaire pour être en mesure de prendre la meilleure décision qui s'impose dans la situation de son enfant. [ 14 ] Il y a donc lieu dans les circonstances d'entériner les mesures recommandées aujourd'hui par la Directrice de la protection de la jeunesse, mesures auxquelles la mère consent. PAR CES MOTIFS, LE TRIBUNAL: [ 15 ] DECLARES that the security and development of the child are compromised according to
section 38 of the Youth Protection Act; [ 16 ] ORDERS that the child be placed in a foster home designated by the A Youth and Family Centres for a period of one (1) year; [ 17 ] TAKES JUDICIAL NOTICE that the child will be placed in a family in Town C; [ 18 ] ORDERS that the frequency and modality of contacts between the child and her mother be determined by the Director of Youth Protection, including supervision if deemed necessary; [ 19 ] AUTHORIZES the Director of Youth Protection of the A Youth and Family Centres to sign any consents on behalf of the child with regards to educational, medical or recreational needs, if the mother cannot be reached in time; [ 20 ] ORDERS that a person working for the A Youth and Family Centres or for any other establishment or organism provide aid, counsel and assistance to the child and her family for a period of one (1) year; [ 21 ] ENTRUSTS the situation of the child to the Director of Youth Protection A, who shall then see that the measures are carried out.
