Partie défenderesse et demanderesse reconventionnelle ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] La
partie demanderesse David Kramer, en sa qualité de liquidateur de la succession de Thomas Kramer, réclame la somme de 6 000 $ pour les motifs ainsi énoncés à la demande datée du 7 décembre 2018 : « 1. On August 3, 2018, Defendant, Ms Lise Robineau, signed an Acknowledgement of Indebtedness and Undertaking in favor of Plaintiff which reads as follows: ʺThis is to record that Thomas Kramer made to Lise Robineau a number of loans totalling $6,000.00.
Since the income of Lise is not sufficient for repayment of this amount, Lise has made arrangement with her Life Insurer to replace all beneficiaries of the insurance with the name of Thomas Kramer. Thomas has agreed that he will deduct the debt of Lise from the insurance payment and provide the balance amount to Nathalie Filion, the daughter of Lise. Lise will provide to Thomas Kramer a copy of her life insurance indicating that he is the beneficiary should Lise die.
If Thomas Kramer should pre-decease Lise, the beneficiary will be David Kramer, son of Thomas. ʺ, The said Acknowledgement of Indebtedness and Undertaking filed as Exhibit P-1; 2. Verbally and by e-mail of August 8, 2018, to Plaintiff, Defendant Lise Robineau advised Plaintiff that of the $6,000.00 lent to her by Plaintiff, Defendant Lise Robineau had remitted $1,000.00 to Defendant Natalie Filion, the said e-mail is filed as Exhibit P-2; 3.
At the time that Lise robuineau gave her daughter, Defendant Natalie Filion, $1,000.00, Lise Robineau was insolvent and this to the knowledge of Defendant Natalie Filion, from having taken over the administration of Defendant Lise Robineau’s affairs as appears from Defendant Lise Robineau’s e-mails of April 16, 2018 and April 25, 2018, to Plaintiff, Exhibit P-3; 4. The Acknowledgement of Indebtedness and Undertaking (Exhibit P-1) provides that Defendant, Lise Robineau, made arrangements
with her life insurer to make a pledge of beneficiary of all of her policies so that upon her death Plaintiff would be paid in full with the understanding that Plaintiff would then remit any balance to Defendant Natalie Filion; 5.
Since the signing of the Acknowledgement of Indebtedness and Undertaking (Exhibit P-1) Defendant Lise Robineau has advised Plaintiff by e-mail of August 27, 2018, and verbally that she will not make him the beneficiary of her insurance policies, will not advise him of the name of her insurers so that he can notify them of the change of beneficiary nor pay the said sum of $6,000.00, the said e-mail filed as Exhibit P-4; 6.
From defendant Lise Robineau’s e-mail of August 27, 2018 (Exhibit P-4) it is apparent that the only insurance which she holds in an insurance policy issued by CMHC which, in any event, is not a life insurance policy but rather a policy to secure a mortgage on a home as is evident from the FAQs- Mortgage Loan Insurance published on the CMHC’s website on March 31, 2018, and retrieved on October 20, 2018. Exhibit P-5; 7.
By letter dated September 10, 2018, Plaintiff’s attorneys wrote to both Defendants demanding, in the case of Lise Robineau re- payment of the full sum of $6,000.00 and in the case of Natalie Filion payment of the sum of $1,000.00, copy of the letter filed as Exhibit P-6; 8.
Plaintiff is entitled to demand interest at the rate of 5% per annum as and from the date of the service of the demand letter, namely, September 12, 2018; » (sic) [ 2 ] Le 21 décembre 2021, le syndic Labelle Marquis inc. transmettait au Tribunal un avis de suspension des procédures dans le présent dossier contre la défenderesse Lise Robineau. [ 3 ] Le jour de l’audience tenue devant la soussignée le 15 février 2022, la défenderesse Natalie Filion était absente, bien que dûment convoquée et appelée; [ 4 ] De la preuve testimoniale et documentaire (P-1 à P-9) offerte par la
partie demanderesse, le Tribunal retient ce qui suit comme étant pertinent à la solution du litige opposant les parties. [ 5 ] Le 3 août 2018 (P-1), feu Thomas Kramer a reçu une reconnaissance de dette signée par la défenderesse Lise Robineau pour un montant de 6 000 $, alors que le 8 août 2018, elle remettait la somme de 1 000 $ à sa fille la défenderesse Natalie Filion. [ 6 ] Considérant l’absence totale de preuve des allégations au soutien de sa défense compte tenu de son absence devant le Tribunal, le Tribunal retient le témoignage offert par monsieur David Kramer à l’effet que la défenderesse Natalie Filion a convenu, compte tenu de l’état d’insolvabilité de sa mère Lise Robineau, de rembourser la somme de 1 000 $ à monsieur feu Thomas Kramer.
POUR CES MOTIFS, LE TRIBUNAL : [ 7 ] ACCUEILLE partiellement la demande; [ 8 ] CONDAMNE la défenderesse Natalie Filion à payer au demandeur David Kramer, en sa qualité de liquidateur de la succession de Thomas Kramer, la somme de 1 000 $ avec intérêts au taux légal et l’indemnité additionnelle prévue à l’article 1619 du Code civil du Québec à compter de la mise en demeure du 10 septembre 2018, avec les frais judiciaires de 187 $, [ 9 ] REJETTE la demande reconventionnelle de la défenderesse Natalie Filion, sans frais. __________________________________ MICHELINE LALIBERTÉ, J.C.Q.
