SUMMARY 1.1. Litigation [ 1 ] Plaintiff claims from defendant damages resulting from a disagreement between the parties about roaming charges charged by Koodo to his account in December 2016, January 2017 and February 2017. [ 2 ] Plaintiff filed his claim on September 9, 2022. [ 3 ] The Court concludes that Plaintiff filed his claim more than three years after his disagreement concerning the roaming charges, therefore outside the prescriptive period of three years to institute legal proceedings provided for at 2925 of Civil code of Quebec . FOR THESE REASONS, THE COURT: DISMISSES Plaintiff demand.
