Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on August 21, 2017. [ 2 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de prolonger son ordonnance rendue le 23 juin 2016. [ 3 ] Plus spécifiquement, elle demande de confier X (11 ans) auprès de sa grand-mère maternelle et qu’un suivi social soit offert à la famille pour une année.
L’objectif de la Directrice est d’établir un projet de vie pour l’enfant et que la grand-mère maternelle devienne la tutrice de l’enfant. [ 4 ] Les parents sont conscients de leurs limites depuis leur accident et admettent ne pas être en mesure de s’occuper de leur fils à long terme. Ils sont en accord avec le projet de la Directrice. [ 5 ] L’avocate de l’enfant, indique que ce dernier maintient son désir d’être confié à sa mère, mais que eu égard à la situation de ses parents, qu’il est en accord avec les mesures proposées.
ANALYSIS OF THE EVIDENCE AND DECISION [ 6 ] Lors de la dernière audition, le dossier procède selon la procédure accélérée. Tous sont alors d’accord pour maintenir l’enfant auprès de sa grand-mère maternelle.
[ 7 ] Depuis cette dernière ordonnance, la situation demeure la même. Les parents, en raison de leurs limites cognitives dues au traumatisme crânien qu’ils ont subi lors d’un accident, ne sont pas en mesure de s’occuper à temps plein de l’enfant. [ 8 ] Les parents n’ont pas la force émotive leur permettant d’offrir à l’enfant la structure et l’encadrement dont il a besoin. [ 9 ] L’enfant a des besoins particuliers, il éprouve des difficultés comportementales et est médicamenté en raison de son TDAH.
Ce dernier évolue positivement auprès de sa grand-mère qui lui offre le support nécessaire à ses besoins particuliers. [ 10 ] Les parties admettent qu’il est important pour l’enfant d’avoir un projet de vie clair et défini. [ 11 ] La grand-mère maternelle est prête à s’investir à long terme dans la vie de l’enfant et de devenir son tuteur. Les parents sont en accord avec ce plan. [ 12 ] Les parents continuent à avoir des contacts réguliers avec l’enfant qu’ils veulent maintenir. [ 13 ] Le Tribunal estime que les mesures proposées correspondent au meilleur intérêt et au respect des droits de l’enfant.
CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 14 ] GRANTS the present motion; [ 15 ] DECLARES that the security and development of the child are still compromised; AND IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY
SECTION 91 OF THE YOUTH PROTECTION ACT: [ 16 ] ORDERS that the child remain in the foster home of his maternal grandparents, Mr. and Mrs.
C; [ 17 ] TAKES JUDICIAL NOTICE that subsidized tutorship is being explored; [ 18 ] ORDERS that the contacts between the child and his parents be determined by agreement between the parties; [ 19 ] ORDERS that the child continue to receive all health care and health services required by his situation, namely for his ADHD and his anger issue; [ 20 ] WITHDRAWS from the parents their attributes of parental authority pertaining to child’s needs for education, medical, therapeutic, social activities and traveling purposes, including obtaining a passport, and GRANTS this signing attributes to the maternal grandmother, Mrs.
C; [ 21 ] ORDERS that aid, counsel and assistance be provided to the child and his family; [ 22 ] ENTRUSTS the situation of the child, X , to the Director of Youth Protection of le centre intégré universitaire de santé et services sociaux A, who shall the see that the measures are carried out; [ 23 ] ORDERS the execution of the present judgment by any peace officer, if necessary; [ 24 ] THE WHOLE for a period of one (1) year.
