Q., Third Party ______________________________________________________________________ ORDER OF CONFINEMENT (S. 396 and following CCP) ______________________________________________________________________ [ 1 ] Considering the Motion for confinement following a psychiatric assessment presented following sections 26 and following of the CCQ , of

section 9 of the Act respecting the protection of persons whose mental state presents a danger to themselves or to others and of sections 396 and following of the CCP ; [ 2 ] Considering the psychiatric assessment of both psychiatrists, Dr. Gisèle Chiniara and Dr.

Dominique Thouin respectively dated September 2 nd , 2020, and September 4 th , 2020, both concluding to the necessity of the Defendant’s confinement; [ 3 ] Considering the motion was duly notified to the Defendant and to the Third party; [ 4 ] Considering the evidence establishing each of the motion’s alleged facts; [ 5 ] Considering the testimony of the social worker, Mrs. Noemie Holmes; [ 6 ] Considering the evidence submitted to the effect that the Defendant, due to her mental state, must be confined in an establishment considering the danger she presents to herself and to others.

Indeed, the Defendant suffers from psychotic symptoms, hallucination, Alzheimer’s disease. FOR THESE REASONS, THE COURT : [ 7 ] GRANTS the Motion for confinement following a psychiatric assessment; [ 8 ] ORDERS the confinement of the Defendant, R. S., in the establishment situated at 215, boulevard York Ouest, Gaspé (Québec), G4X 2W2, or any other establishment designated by the Director of professionnals services of the Centre intégré de santé et de services sociaux de la Gaspésie for a maximum period of 30 days following the judgment; [ 9 ] ORDERS that the judgment be notified to Mrs. D.

Q., Third party; [ 10 ] ALLOWS , if necessary, the execution of the present judgment by a peace officer; [ 11 ] WITHOUT COSTS .
