DESCRIPTION: Motion for leave to appeal interlocutory judgments rendered on 24 February 2015 and 7 May 2015 respectively by the Honourable Judge Jacques R. Fournier of the Superior court, district of Montreal Clerk: Mihary Andrianaivo Courtroom: RC-18 HEARING
9:50 Commencement of the hearing. Submissions by Mtre Parienté. 9:54 Submissions by Ms. Rissaki. 10:01 By the Judge: Judgment – See page 3. End of the hearing. Mihary Andrianaivo Clerk BY THE JUDGE JUDGMENT [ 1 ] The Petitioner is seeking leave to appeal from two judgments rendered by Chief Justice Jacques R.
Fournier of the Superior Court on February 24, 2015 and May 7, 2015. [ 2 ] These are two case management judgments that fix the duration of the trial. [ 3 ] As such, they do not satisfy the requirements of art. 29 C.c.p. as they do not decide definitely any issue, they do not order the doing of anything which could not be remedied by the final judgment nor do they unnecessarily delay the trial. THEREFORE, THE UNDERSIGNED: [ 4 ] DISMISSES the motion without costs. FRANÇOIS DOYON, J.A.
