The following is the judgment delivered by THE COURT (Orally) [ 1 ] The application judge granted an application for a declaration under s. 35.1 (
a) of the Wills Act , R.S.N.B. 1973, c. W-9, that the purported last will and testament of the late Jean Agnes MacDonald Marsden be declared valid and fully effective as if it had been executed in compliance with the formal requirements imposed by the Act . The decision is reported at Marsden Estate (Re) , 2017 NBQB 199 , 2017 N.B.J. No. 295 (QL) . Having regard to the application judge’s comprehensive reasons and his determination the draft will embodied the testamentary intentions of Mrs. Marsden, we can find no justification to interfere.
Furthermore, s. 2.02(7.2) of Regulation 84-9 of the Probate Court Act , R.S.N.B. 1973, c. P-17 .1 permitted the application judge to accept evidence as he considered satisfactory to determine whether the document met the requirements of s. 35.1 of the Act . We are in substantial agreement with the essential features of the carefully considered reasons of the application judge. [ 2 ] The appeal is dismissed with one set of costs payable by the appellants to the respondent in the amount of $1,500.
