Section 95- 95.1 of the Youth Protection Act (L.R.Q., C. P-34.1 ) WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified. Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] JD2620 The Court hereby confirms and provides written reasons for a decision rendered verbally at the hearing of June 14, 2016, in accordance with the requirements of
section 90 of the Youth Protection Act [1] . [ 2 ] The Court was presented with a motion for extension of an order rendered by the undersigned, on March 16, 2015, whereby the now sixteen year-old adolescent, X , was entrusted to her mother with aid, counsel and assistance, for a period of one year. [ 3 ] The facts alleged in support of the motion for extension dated January 15, 2016, are as follows: 2.1. Depuis la dernière ordonnance, les adolescentes sont confiées à la mère; 2.2. La mère continue d’entretenir des contacts avec le père et demeure impliquée auprès de lui; 2.3.
La mère met les enfants en contact avec le père à l’insu de la Directrice de la protection de la jeunesse qui doit déterminer les modalités et la fréquence des contacts entre le père et les adolescentes; 2.4. Depuis juillet 2015, la collaboration des la mère est difficile en raison de ses absences aux rencontres avec les intervenants; 2.5. Depuis l’automne 2015, le père se présente régulièrement au domicile de la mère et peut adopter une attitude contrôlante; 2.6.
Suite à l’hospitalisation de l’adolescente X pour une infection du colon, le père utilise cette raison pour se présenter au domicile de la mère et y rester de nombreuses heures malgré le souhait contraire de la mère et des adolescentes; 2.7. Les adolescentes verbalisent souhaiter que le père ne se présente pas au domicile de la mère et qu’il ne consomme pas d’alcool, car cela les affecte dans leurs périodes d’étude et dans leur organisation quotidienne; 2.8. Les parents ne participent pas aux services de la Clinique transculturelle Jean-Talon; 2.9. Le père n’a pas entrepris un suivi en toxicomanie; 2.10.
Les parents collaborent peu avec les intervenants afin de résorber la situation de compromission (reproduced with errors and/or omissions).
[ 4 ] In light of the foregoing, the Director recommends that the adolescent remain entrusted to her mother, at the exclusion of the father, with aid, counsel and assistance, as well as additional corrective measures, for a period of nine months. [ 5 ] The mother, who chose to proceed without the assistance of legal counsel, admitted most of the alleged facts and consented to the proposed measures. [ 6 ] The father, assisted by Me Grondin, also admitted most of the alleged facts and consented to the proposed measures, except to participate in a treatment program for alcohol abuse. [ 7 ] The adolescent, assisted by Me Benoit, admitted all the alleged facts regarding her own situation and agreed with the proposed measures. [ 8 ] The Director filed Exhibits D-5 and D-6 as evidence: D-5: Rapport d’étude de la situation sociale de l’enfant, rédigé par madame [intervenante 1], personne autorisée par la DPJ, daté du 19 février 2016 ; D-6: Rapport complémentaire d’étude de la situation sociale de l’enfant, rédigé par madame [intervenante 1], personne autorisée par la DPJ, daté du 9 juin 2016 . [ 9 ] In
summary, the evidence establishes the facts alleged in support of the motion. [ 10 ] The father’s presence is deeply disruptive and disturbing to the adolescent whose studies and psychological well-being are perturbed by the father’s erratic behavior. [ 11 ] Unfortunately the mother’s financial dependence and reliance on the father appears to encourage his controlling behavior. [ 12 ] Clear boundaries need to be set and enforced to protect the adolescent from the father’s intrusive behavior especially while under the influence of alcohol. [ 13 ] As a result, contacts between the father and adolescent must only occur outside the family home, as determined by the Director of Youth Protection, taking into account the adolescent’s wishes. [ 14 ] Under the circumstances, given the evidence and the consent expressed by each of the parties, the Court is satisfied that the motion is well-founded and that the recommendations are in the adolescent's interest.
THEREFORE, THE COURT: [ 15 ] GRANTS the motion; [ 16 ] DECLARES that the security and development of the adolescent, X , remain compromised under the Youth Protection Act ; AS FOR THE MEASURES, THE COURT DEEMS IT TO BE IN THE ADOLESCENT'S INTEREST TO ORDER THE FOLLOWING MEASURES: [ 17 ] ORDERS that the adolescent be entrusted to her mother, at the exclusion of the father; [ 18 ] ORDERS that the frequency and modality of contacts between the adolescent and her father be determined by the Director of Youth Protection, taking into account the adolescent’s wishes, including determining the degree of supervision if necessary TAKING JUDICIAL NOTICE that the adolescent does not wish to have any such contact at the moment; [ 19 ] ORDERS that the contacts, when the adolescent will be ready for them, are not to occur in the family home under any circumstances; [ 20 ] RECOMMENDS that the father undergo a substance abuse assessment and follow any recommendations that may be made; [ 21 ] ORDERS that the father not consume any alcohol in the presence of the adolescent; [ 22 ] ORDERS that the parents report to the Director of Youth Protection on the measures taken and collaborate with the Director of Youth Protection; [ 23 ] RECOMMENDS that the family benefit from the services from the Clinique transculturelle Jean-Talon, as soon as possible, more particularly as soon as the adolescent’s health allows her to participate; [ 24 ] ORDERS that a person working for [center A] provide aid, counsel and assistance to the adolescent and her family; [ 25 ] ENTRUSTS the situation of the adolescent, X , to the Director of CIUSSS A, who shall then see that the measures are carried out; [ 26 ] ORDERS the execution of the present judgment by any peace officer, if necessary; [ 27 ] THE WHOLE for a period of nine months.
