Asma Berrak Clerk JUDGMENT [ 1 ] The appellant Raymond Turmel presents an “Application to consolidate and for stay of preliminary inquiry”. [ 2 ] Contrary to the Rules of the Court in criminal matters, the application does not indicate the precise provisions of the statute or regulation upon which the requests are based.
Contrary to the same Rules as well, it is not accompanied by what is required for the consideration of the application (for instance, the transcripts of the three judgments referred to in the application which are not, by the way, attached either to the «Notice of appeal» filed in that regard by the appellant in the three appeal court files listed on his application). [ 3 ] In a context where the respondent’s attorney indicates that his intention is to file motions to dismiss the three appeals at issue for lack of a proper right of appeal, the request to consolidate the files is, for the moment, premature and uncalled for. [ 4 ] As for the request to stay the preliminary inquiry, the application contains no allegations whatsoever in support of it.
There is no basis in law for the motions’ judge of this Court to do so. FOR THESE REASONS : [ 5 ] The application is DISMISSED . CLÉMENT GASCON, J.A.
