Loi sur la protection de la jeunesse visant à faire déclarer la sécurité et le développement de l'enfant, X, compromis pour le motif suivant: - The child's parents do not meet the child's basic needs by failing to give him the care required for his physical health, namely by filing to take the necessary steps in order for the child to receive the proper dental care he requires. [ 2 ] Toutes les formalités exigées par la loi ayant été observées le Tribunal a procédé à l'enquête conformément aux dispositions de l'article 77 de la
Loi sur la protection de la jeunesse. [ 3 ] Le père et l'enfant ont consentis aux conclusions recherchées. [ 4 ] Le rapport de l'intervenante de la direction de la protection de la jeunesse madame [intervenante 1] a été déposé sous la cote D-1 et elle a été entendue comme témoin ainsi que la mère, madame [intervenante 2]. [ 5 ] La preuve a révélé que l'enfant X a besoin de soins dentaires rapidement, car il a de nombreuses caries, un abcès à la gencive ce qui lui entraîne des douleurs et malheureusement les suivis ne sont pas faits bien que de nombreux services ont été offerts pour aider les parents à régler le problème. [ 6 ] L'intervenante, tel que confirmé par son témoignage, tient les propos suivants à son rapport au sujet de la situation: «X needs to receive care now.
This was pointed out multiple times to the mother. Our appearance in Court is our ultimate resource to show the mother the necessity to give her son the care he needs. What X requires is not complicated to provide. He needs to have X- Rays done at the hospital and see his family doctor for his anesthesia pre-exam. After this he will be on a waiting list. The last step will be to bring him to his appointment. It was difficult to work with Ms. A and her lack of care for her son.
She is very centered on her needs rather then her son's needs and always turn things around to make it seem like she is a victim of the situation. […] X is complaining about pain, has had multiple abscesses that have not been treated and that can cause irrecoverable damage. When an abscess «breaks», it is poison for the body, it either lodges itself on healthy organs and weakens them or goes straight to the throat and creates pain. Due to this fact and the fact that his permanent teeth are being affected we must act quickly and give him the care needed.»
[ 7 ] La mère a fourni des explications, mais qui ne convainquent pas la Cour sur l'à-propos de ces démarches. [ 8 ] Il est impérieux que l'enfant reçoive les soins appropriés. [ 9 ] Compte tenu des consentements donnés et la preuve offerte; THEREFORE THE COURT : GRANTS the petition; DECLARES that the security and the development of the child are compromise for the motives alleged in the said petition; ORDERS that the child, X, remain with his family; ORDERS that the child receive the proper dental cares he requires and to that effect the Court: • PERMITS the Youth Protection Director to set all appointments that the dental health situation of the child required; • ORDERS the mother participate actively to all these appointments and that she takes the necessary steps to have the child present; ORDERS the parents to report periodically to the Youth Protection Director on the measures they apply in their own regard or in their child's regard to put an end to the situation in which the security or development of the child is in danger; ORDERS the parents to participate at the elaboration of the intervention plan; ORDERS that the person authorized by the Director of Youth Protection provides aid, counsel and assistance to the child and his family for a period of six months; ENTRUSTS the situation of the child to the Director of Youth Protection who shall then see that the measures are carried out. __________________________________ MICHEL SÉGUIN, J.C.Q.
