CHRYSLER CANADA INC. and LONGUEUIL DODGE CHRYSLER JEEP LTÉE Defendants ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] On April 22, 2004, plaintiff 9097-6648 Québec Inc. bought a 2005 Chrysler 300 automobile, from Longueuil Dodge Chrysler Ltée (exhibit P-3). [ 2 ] Seven years later, namely on January 12, 2011, plaintiff Seymour Avrith had the transmission repaired by Transmissions Unlimited, in North Miami Beach, Florida (exhibit P-2). [ 3 ] Plaintiffs are now suing defendants for the price of the repairs, plus $500.00 for "out of pocket" expenses, citing "defective parts". [ 4 ] Plaintiff Avrith sent a demand letter to defendants, on January 16, 2011, after the repairs were carried out. [ 5 ] Whereas this is contrary to articles 1595 and 1739 of the Civil Code of Quebec , and constitutes a "fin de non recevoir" to the action, which must be dismissed. [ 6 ] Finally, it is to be noted that defendant Longueuil Dodge Chrysler Ltée ceased operating in August, 2009, and was liquidated in January, 2011.
WHEREFORE THE COURT HEREBY: DISMISSES plaintiffs' application as amended, with costs in favour of Chrysler Canada Inc. only. __________________________________ ELIANA MARENGO, J.C.Q. Date of hearing : March 11, 2013
