Protection de la jeunesse — 172884 2017 QCCQ 6353 COURT OF QUÉBEC Youth Division CANADA PROVINCE OF QUÉBEC DISTRICT [...] LOCALITY [...] Nos. 525-41-031038-169 525-41-031040-165 DATE: February 13, 2017 ______________________________________________________________________ PRESENT: THE HONOURABLE PATRICE HURTUBISE J.C.Q. ______________________________________________________________________ In the situation of: X (Born on […], 2016) Y (Born on […], 2012) and A Father–petitioner and DIRECTEUR DE LA PROTECTION DE LA JEUNESSE DES CENTRES DE LA JEUNESSE ET DE LA FAMILLE A Impleaded party and B Parent–respondent JUDGMENT [1] JH5272 (section 95, Youth Protection Act ) [ 1 ] The father filed a motion for the review of an order rendered on November 11, 2016 by the undersigned. [ 2 ] Mr.
A wishes to resume living with the children’s mother. He did not take
part in an anger management program. He stated that the program was too tedious, as it included about 20 sessions. [ 3 ] It will be noted that participation in the program was also part of the release conditions issued by the Criminal Division further to charges of assaulting the mother. [ 4 ] Moreover, the father stated that he began courses to improve his parental capacities. [ 5 ] Mr. A did not submit as evidence new facts likely to change the decision rendered in November.
He did not participate in an anger management program or submit a valid alternative that would remedy the initial grounds for endangerment (the children’s exposure to conjugal violence). FOR ALL THESE REASONS, THE COURT: [ 6 ] DISMISSES the motion. Signed in Town A, April 26, 2017.
