SPVM Defendant ______________________________________________________________________ JUDGMENT ON A DEMAND TO SET A TRIAL DATE BY PREFERENCE ______________________________________________________________________ [ 1 ] The Plaintiff seeks that her case be heard in preference.

She alleges that she is a victim of crime and a survivor of torture that was conducted by the Ottawa police and for which she filed a claim before the Ontario Human Right Tribunal for racial policing. [ 2 ] On July 27, 2020, she also filed a claim against the City of Montreal Police Service before the Small Claims Division of this court in which she states that she is a victim of crime by highly oppressive countrywide police targeting which would have caused her damages in the amount of $250,000, but reduced within the limits of the Small Claims Division jurisdiction to $15,000. [ 3 ] She further argues that the forthcoming judgment in the present case is likely to have a serious impact on her claim before the Ontario Human Right Tribunal and that therefore it is urgent that her claim be heard in preference. [ 4 ] With great respect, the Court cannot reach this conclusion. [ 5 ] The Plaintiff does not allege nor does she prove any reasons, particular circumstances or a factual situation which would lead her to suffer any irreparable prejudice should her case not be heard in preference rather than proceeding within the normal delays.

She does not further allege that her case raises any complex issues beyond the ones that are raised in any other case.
