CONSEIL QUÉBÉCOIS SUR LE TABAC ET LA SANTÉ JEAN-YVES BLAIS CÉCILIA LÉTOURNEAU RESPONDENTS – Plaintiffs and ATTORNEY GENERAL OF CANADA IMPLEADED PARTY – Defendant in warranty JUDGMENT [ 1 ] Rothman's, Benson & Hedges is a defendant in the Superior Court in the consolidated class actions brought against it and two other tobacco manufacturers claiming compensatory and punitive damages arising out of the use of their tobacco products. It seeks leave to appeal a judgment of the Honourable Mr.
Justice Brian Riordan rendered during trial that orders it to disclose its complete financial statements to the plaintiffs in the Superior Court from 2007 forward until to the conclusion of the trial, subject to a confidentiality undertaking. [ 2 ] In a judgment being released concurrently in the case of Imperial Tobacco v. Conseil québécois sur le tabac et la santé et al . (C.A.M. 500-09-022889-125), I adjudicate a similar motion brought by a co-defendant of Rothman's, Benson & Hedges arising out of the same judgment of Riordan, J.
My reasons dismissing Imperial Tobacco's motion apply to determine the outcome of the motion for leave to appeal in this case, which is accordingly dismissed with costs. ALLAN R. HILTON, J.A.
