[ 1 ] Le Tribunal est saisi d'une requête en vertu de l'article 38 de la
Loi sur la protection de la jeunesse. [ 2 ] Les parents sont à peine sortis de l'adolescence. [ 3 ] Ils entretiennent une relation conflictuelle et violente. [ 4 ] Le père est arrêté au courant de l'automne et remis en liberté avec certaines conditions, notamment de ne pas être en contact avec la mère. [ 5 ] Il est arrêté de nouveau en janvier. Il doit maintenant répondre à diverses accusations de voies de fait, menaces, agression sexuelle, entraves et bris de probation.
Il demeure en détention. [ 6 ] Il reconnaît devoir travailler sur son problème de gestion de la colère. [ 7 ] La mère affirme avoir maintenant compris qu'elle doit mettre fin à cette relation nocive. Soulignons qu'elle a été exposée à de la violence conjugale pendant son enfance. Son degré de maturité est préoccupant. [ 8 ] Le Directeur recommande l'hébergement de l'enfant pour les 9 prochains mois tout en autorisant la réinsertion sociale après 6 mois.
[ 9 ] La preuve ne donne pas ouverture à une telle possibilité. À l'heure actuelle, madame A en est toujours au stade des bonnes intentions. Ses capacités parentales sont à démontrer. Il faudra voir si elle est capable de concrétiser ses engagements. [ 10 ] Le père préfèrerait que son fils demeure avec sa mère alors qu'elle-même, consent à l'hébergement. FOR ALL THESE REASONS, THE COURT: [ 11 ] GRANTS the petition; [ 12 ] DECLARES that security and development of the child are compromised according to
section 38
b) and
c) of the Youth Protection Act ; [ 13 ] ENTRUSTS the situation of the child to the Director of Youth Protection of A, who shall then see that the measures are carried out; [ 14 ] ENTRUSTS the child to a confidential foster home; [ 15 ] ORDERS that contacts between mother and child take place following modalities to be established by the Director at a frequency to be agreed upon between the parties, failing an agreement, the frequency will be once a week; [ 16 ] ORDERS that contacts between father and child take place after the father is released from detention and according to modalities to be established by the Director at a frequency to be agreed upon between the Director and the father, and under direct supervision from the Director; [ 17 ] TAKES ACT of mother's commitment to meet a psychologist for an evaluation and to pursue her therapeutic steps; [ 18 ] TAKES ACT of father's commitment to work on his anger management issues; [ 19 ] RECOMMENDS that parenting courses be offered to the mother; [ 20 ] ORDERS aid, counsel and assistance to the child and his parents including help to find appropriate therapeutic support; [ 21 ] ORDERS the execution of the judgment by any peace officer, if needed; [ 22 ] THE WHOLE for 9 months.
