Asma Berrak Greffière JUDGMENT [ 1 ] Considering the strict standards of appellate review with respect to an appeal from sentence, I am of the view that there is almost no choice that this Court, sitting on the merits, would intervene to substitute a custodial sentence, as the Crown contented in the Court of Quebec. [ 2 ] Having recognized that a custodial sentence might be appropriate, the trial judge nevertheless carefully explained the reasons that led him to sentence Ms X to 75 hours of community service to be performed within 6 months, followed by a probation order of one year.
FOR THESE REASONS: [ 3 ] The motion for leave to appeal is dismissed. With respect to the second motion, it has become academic, and therefore is dismissed.
