Article 95 de la Loi sur la protection de la jeunesse ______________________________________________________________________ [ 1 ] Le tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 16 octobre 2012, conformément aux exigences de l’article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] Comme le permet Kellogg’s Company of Canada c. P.G. du Québec , [1978] C.A. 258 , 259-260, le tribunal s’est réservé le droit, au moment de rendre sa décision, d’en modifier, amplifier et remanier les motifs.
La soussignée les a remaniés pour en améliorer la présentation et la compréhension. [ 3 ] Le tribunal doit déterminer s’il est dans l'intérêt de X et Y et A de prolonger la décision rendue le 25 janvier 2012 et s’il est dans l’intérêt de Z de prolonger la décision rendue le 16 avril 2012. [ 4 ] À cette date, le tribunal confie X et Z en centre de réadaptation alors que Y et A sont confiées à une famille d’accueil.
Le tribunal impose en outre des mesures ayant pour but de mettre fin à la situation de compromission. [ 5 ] Le père reconnaît être incapable de prendre charge de ses enfants. [ 6 ] Au rapport produit sous la cote D-2, on lit : “(…) Ms. B’ (sic) have done remarkably well and have made tremendous gains. She continues to meet with her children on a regular basis and spends quality time with them.” [ 7 ] La mère a fait tout ce que la Directrice de la protection de la jeunesse lui a suggéré.
Ella l’a fait honnêtement, s’est mise en action et a apporté des changements importants dans sa vie. [ 8 ] En conséquence la Directrice de la protection de la jeunesse demande que Y et A soient confiées à leur mère dès aujourd’hui. Quant à X et Z, leur retour est prévu au cours des 6 prochains mois. [ 9 ] Z va très bien et dès que possible il pourra être réintégré auprès de sa mère.
[ 10 ] Quant à X, il est en difficulté scolaire et ne respecte pas les couvre-feux imposés lorsqu’il se retrouve dans la communauté. Il se met en danger, ne se responsabilise pas de ses gestes, ne respecte pas les rendez-vous avec son psychologue. [ 11 ] Tout repose entre ses mains à compter d’aujourd’hui.
Il doit réaliser que s’il veut retourner chez sa mère, il doit assumer les conséquences de ses gestes et de ses choix. [ 12 ] Quant au père, il déclare vouloir reprendre les contacts avec ses enfants. [ 13 ] Après avoir reçu les admissions, pris en considération la position des parties et la preuve testimoniale et documentaire, le tribunal estime que les faits prouvés et admis permettent la prolongation des ordonnances rendues les 25 janvier 2012 et 16 avril 2012 et qu'il est dans l'intérêt des enfants et le respect de leurs droits de rendre l'ordonnance qui suit. [ 14 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 15 ] GRANTS the motion; [ 16 ] DECLARES that the security and the development of X and Y and Z and A are still in danger; [ 17 ] EXTENDS the orders rendered on January 25, 2012 and April 16, 2012; [ 18 ] In the cases of Y and A : [ 19 ] ORDERS that Y and A reintegrate their mother’s care as of today; [ 20 ] ORDERS that frequency and modality of contacts between Y and her father be determined by the Director of Youth Protection, including supervision if deemed necessary and as long as necessary; [ 21 ] ORDERS that frequency and modality of contacts between A and Mr.
C be determined by the Director of Youth Protection, including supervision if deemed necessary and as long as necessary; [ 22 ] TAKES JUDICIAL NOTICE of the fact that the Director of Youth Protection will try to find a place in or near City A where A and Y can meet with Mr.
C in a supervised environment for a few contacts at the beginning; [ 23 ] ORDERS mother to continue to participate in her substance abuse treatment; [ 24 ] AUTHORIZES the Director of Youth Protection to share and obtain pertinent information with the treatment providers working with the family; [ 25 ] AUTHORIZES the Director of Youth Protection, given mother’s agreement, to share with all the children’s therapists all the pertinent information obtained; [ 26 ] ORDERS Mr. C to seek treatment regarding his substance abuse and conjugal violence; [ 27 ] TAKES JUDICIAL NOTICE of the fact that Mr.
C is attending Center A and that he will ask to add a conjugal violence component to his treatment; [ 28 ] ORDERS Mr. C, given his agreement, to submit to random and alcohol testing when asked by the Director of Youth Protection; [ 29 ] ORDERS mother and Mr. C to ensure that Y and Aare not exposed to any type of violence, verbal and/or physical; [ 30 ] ORDERS that contacts among the siblings be encouraged; [ 31 ] AUTHORIZES the Director of Youth Protection to communicate with center A to verify the attendance and the progress of Mr.
C; [ 32 ] TAKES JUDICAL NOTICE of the fact that the Director of Youth Protection will try to work in collaboration with the Director of Youth Protection in City A so Mr.
C will have his own social worker; [ 33 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to Y, A and their family; [ 34 ] THE WHOLE for a period of six (6) months; [ 35 ] In the case of Z : [ 36 ] ORDERS that Z remain in a rehabilitation centre for a period of six (6) months; [ 37 ] ORDERS that the frequency and modality of contacts between Z and his mother be determined by the Director of Youth Protection, including supervision if deemed necessary and as long as necessary; [ 38 ] ORDERS that the frequency and modality of contacts between Z and Mr.
C be determined by the Director of Youth Protection, including supervision if deemed necessary and as long as necessary; [ 39 ] ORDERS mother to continue to participate in her substance abuse treatment; [ 40 ] AUTHORIZES the Director of Youth Protection to share and obtain pertinent information with the treatment providers
working with the family; [ 41 ] AUTHORIZES the Director of Youth Protection, given mother’s agreement, to share with all the children’s therapists all the pertinent information obtained; [ 42 ] ORDERS Mr. C to seek treatment regarding his substance abuse and conjugal violence; [ 43 ] TAKES JUDICIAL NOTICE of the fact that Mr. C is attending center A and that he will ask to add a conjugal violence component to his treatment; [ 44 ] ORDERS mother and Mr.
C to submit to random drug and alcohol testing; [ 45 ] ORDERS Z to follow the recommendations of the psychological assessment dated May 15, 2012; [ 46 ] ORDERS the Director of Youth Protection to make sure that the recommendations of the psychological assessment are put in place; [ 47 ] ORDERS mother and Mr. C to ensure that Z is not exposed to any type of violence, verbal and/or physical; [ 48 ] ORDERS that contact among the siblings be encouraged; [ 49 ] AUTHORIZES the Director of Youth Protection to communicate with center A to verify the attendance and the progress of Mr.
C; [ 50 ] ORDERS that contacts between Z and his extended family in [province A] be encouraged; [ 51 ] AUTHORIZES the Director of Youth Protection to share information with social services in [province A] pertaining to the situation of the family; [ 52 ] TAKES JUDICIAL NOTICE of the fact that the Director of Youth Protection will try to find a place in or near City A where Z can meet with Mr.
C in a supervised environment for a few contacts at the beginning; [ 53 ] TAKES JUDICAL NOTICE of the fact that the Director of Youth Protection will try to work in collaboration with the Director of Youth Protection in City A so Mr.
C will have his own social worker; [ 54 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to Z and his family; [ 55 ] THE WHOLE for a period of six (6) months; [ 56 ] In the case of X: [ 57 ] ORDERS that X remains in a rehabilitation centre for a period of six (6) months; [ 58 ] ORDERS that frequency and modality of contacts between X and his parents be determined by the Director of Youth Protection including supervision if deemed necessary and as long as necessary; [ 59 ] TAKES JUDICIAL NOTICE of the fact that the Director of Youth Protection will try to find a place in or near City A where X can meet with his father in a supervised environment for a few contacts at the beginning; [ 60 ] ORDERS mother to continue to participate in her substance abuse treatment; [ 61 ] AUTHORIZES the Director of Youth Protection to share and obtain pertinent information with the treatment providers working with the family; [ 62 ] AUTHORIZES the Director of Youth Protection, given mother’s agreement, to share with all the children’s therapists all the pertinent information obtained; [ 63 ] ORDERS father to seek treatment regarding his substance abuse and conjugal violence; [ 64 ] TAKES JUDICIAL NOTICE of the fact that father is attending center A and that he will ask to add a conjugal violence component to his treatment; [ 65 ] ORDERS the parents to submit to random drug and alcohol testing; [ 66 ] ORDERS the parents to ensure that X is not exposed to any type of violence, verbal and/or physical; [ 67 ] ORDERS that contacts among the siblings be encouraged; [ 68 ] AUTHORIZES the Director of Youth Protection to communicate with center A to verify the attendance and the progress of Mr.
C; [ 69 ] ORDERS that contacts between X and his extended family in [province A] be encouraged; [ 70 ] AUTHORIZES the Director of Youth Protection to share information with social services in [province A] pertaining to the situation of the family;
[ 71 ] TAKES JUDICAL NOTICE of the fact that the Director of Youth Protection will try to work in collaboration with the Director of Youth Protection in City A so Mr.
C will have his own social worker; [ 72 ] STRONGLY RECOMMENDS X to attend a psychological follow-up, be on time and to open himself to this follow-up; [ 73 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to X and his family; [ 74 ] THE WHOLE for a period of six (6) months; [ 75 ] ENTRUSTS the situation of X and Y, Z and A to the Director of Youth Protection of A Youth and Family Centres, who shall then see that the measures are carried out; [ 76 ] ORDERS the execution of the present decision by any peace officer. __________________________________ DOMINIQUE WILHELMY, J.C.Q.
